(Ord. 1133, 1-24-94) (Ord. <br />377 1555, 6-18-2018) <br />378 <br />379 306.07306.08ENFORCEMENTCOMPLIANCE CHECKS: <br />380 <br />381 All licensed premises shall be open to inspection by Roseville law enforcement or other <br />382 authorized City officials during regular business hours. From time to time, but at least twice <br />383 per year, the City shall conduct compliance checks. In accordance with state law, the city will <br />384 conduct compliance checks that involve the participation of a person at least 17 years of age, <br />385 but under the age of 21 to enter the licensed premises to attempt to purchase Licensed <br />386 Products. Prior written consent from a parent or guardian is required for any person under the <br />387 age of 18 to participate in a compliance check. Persons used for the purpose of compliance <br />388 checks will be supervised by law enforcement or other designated personnel. One check will <br />389 be conducted by engaging, with the written consent of their parents or guardians, a person <br />390 over the age of 15 years but less than 17 years of age, to enter the licensed premises to <br />391 attempt to purchase tobacco or tobacco products, tobacco-related devices, or electronic <br />392 delivery devices. A second check may be conducted by engaging a person over the age of 18 <br />393 but less than 21 years of age, to enter the licensed premises to attempt to purchase tobacco, or <br />394 tobacco products, tobacco-related devices, or electronic delivery devices. Persons used for <br />395 the purpose of compliance checks shall be supervised by the Chief of Police, or the Chief of <br />396 PoliceÓs designee. No person used in compliance checks shall attempt to use a false <br />397 identification misrepresenting the personÓs age and all persons lawfully engaged in a <br />398 compliance check shall answer all questions about the personÓs age, asked by the licensee or <br />399 licenseeÓs employee and shall produce any identification, if any exists, for which the person is <br />400 asked. Nothing in the subdivision shall prohibit compliance checks authorized by State or <br />401 Federal laws for educational, research, or training purposes, or required for the enforcement <br />402 of a particular State of Federal law. (Ord. 1555, 6-18-2018) <br />403 <br />404 <br />405 306.08306.09 VIOLATIONS AND PENALTIES: <br />406 A. Violations: <br />407 1. Notice. A person violating this ordinance may be issued, either personally or <br />408 by mail, a citation from the city that sets forth the alleged violation and that <br />409 informs the alleged violator of his or her right to a hearing on the matter and <br />410 how and where a hearing may be requested, including a contact address and <br />411 phone number. <br />412 2. Hearings. <br />413 a. Upon issuance of a citation, a person accused of violating this <br />414 ordinance may request in writing a hearing on the matter. Hearing <br />415 requests must be made within 10 business days of the issuance of the <br />416 citation and delivered to the City Clerk or other designated city <br />417 officer. Failure to properly request a hearing within 10 business days <br />418 of the issuance of the citation will terminate the personÓs right to a <br />419 hearing. <br />420 b.
