Attachment B <br />465 ordinance. <br />466 A. Any person who violates this Chapter shall be subject to criminal, administrative, and/or <br />467 licensing penalties as described in this section. (Ord. 1555, 6-18-2018) <br />468 B. Criminal Penalty: Any person who violates this Chapter shall be guilty of a <br />469 misdemeanor. (Ord. 1555, 6-18-2018) <br />470 C. Administrative Penalty: Any person who violates this Chapter shall be subject to <br />471 administrative offense penalties under Chapter 102 and as set forth in the CityÓs fee <br />472 schedule. (Ord. 1555, 6-18-2018) <br />473 D. Licensing Penalty: In the event any licensee or licenseeÓs employee violates this <br />474 Chapter, the City Council may revoke, suspend, or deny renewal of such license. <br />475 Mandatory minimum suspension periods and revocations shall be set forth in the CityÓs <br />476 fee schedule. (Ord. 1555, 6-18-2018) <br />477 D. Hearing and Notice: Revocation, suspension or denial of renewal of a license shall be <br />478 given to the licensee by a hearing before the City Council. A hearing notice shall be <br />479 given at least ten days prior to the hearing, including notice of the time and place of the <br />480 hearing and shall state the nature of the charges against the licensee. Remedies Not Exclusive: The remedies herein are in addition to any civil and/or <br />483 criminal penalties permitted under State and Federal law. (Ord. 1555, 6-18-2018) <br />484 306. 10 Exceptions and Defenses: <br />485 A. Religious, Spiritual, or Cultural Ceremonies or Practices. Nothing in this ordinance prevents <br />486 the provision of tobacco or tobacco-related devices to any person as part of an indigenous <br />487 practice or a lawfully recognized religious, spiritual, or cultural ceremony or practice. <br />488 B.Reasonable Reliance. It is an affirmative defense to a violation of this ordinance for a person <br />489 to have reasonably relied on proof of age as described by state law. <br />490 <br />491 306.11 SEVERABILITY: <br />492 If any such provision of this Chapter, or the application thereof to any person or <br />493 circumstance, is held invalid, such invalidity shall not affect any other provision of this <br />494 ordinance that can be given effect without the invalid provision or application. Each invalid <br />495 provision or application of this ordinance is severable. (Ord. 1555, 6-18-2018) <br />496 306.12 EFFECTIVE DATE: <br />497 This ordinance becomes effective on the date of its publicationJuly 1, 2021, or <br />498 uponfollowing the publication of a summary of the ordinance as provided by Minn. Stat. § <br />499 412.191, subd. 4, as it may be amended from time to time, which meets the requirements of <br />500 Minn.
