The proposed use will not be injurious to the surrounding neighborhood, will not negatively impact 36 traffic or property values, and will not otherwise harm the public health, safety, and general welfare. 37 The use of residentially zoned lakeshore land for residential lake access adjacent to a public beach, 38 boat launch, and fishing pier will not create adverse traffic impacts, harm property values, or cause 39 harm to the public health, safety, and general welfare. 40 AND WHEREAS the Roseville City Council has made the following findings regarding the 41 additional evaluation criteria for conditional uses in the Shoreland Management Overlay District 42 established in §1017.21.A (Shoreland Conditional Uses); 43 1. The prevention of soil erosion or other possible pollution of public waters, both during and after 44 construction; 45 All applicable erosion control requirements and property maintenance regulations in City Code and 46 from other pertinent agencies will be enforced as normal. 47 2. The visibility of structures and other facilities as viewed from public waters is limited; 48 No structures are proposed other than a dock, but any such structures will need to conform to the 49 zoning requirements pertaining to Water Oriented Accessory Structures. 50 3. The types, uses, and numbers of watercraft that the project will generate can be safely 51 accommodated on the site; 52 Watercraft are regulated by MnDNR. 53 4. The impact the proposed use may have on the water quality of the water body is not excessive. 54 Any use of the proposed controlled access must conform to all applicable requirements of agencies 55 regulating water quality. 56 NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to approve the 57 proposed controlled access, based on the public record and City Council deliberation. 58 WHEREUPON said resolution was declared duly passed and adopted. 59 RCA Attachment F Page 8 of 8
