REQUEST FOR COUNCIL ACTION <br />Date: March 22, 2021 <br />Item No.: 7.b <br />Department Approval City Manager Approval <br />Item Description: Approve Resolution Approving the Vacation of Easements Related to the <br /> The Enclave at McCarronsLake Plat <br />1 B ACKGROUND <br />2 As part of a proposed development, The Enclave at McCarrons, located in the southeast quadrant of <br />3 Galtier Street and South McCarrons Boulevard, the developer’s surveyor has recommended the <br />4 vacation of two (2) utility easements and portion of the South McCarrons Boulevard right-of-way <br />5 running through the property. This recommendation is based on the redevelopment of the site. The <br />6 existing utility easements are not directly over the existing pipes so vacating the easements and <br />7 dedicating new ones will benefit the City. Portions of the South McCarrons Boulevard right-of-way <br />8 would be vacated and a new right-of-way established. The existing right of way is 99 feet in width <br />9 and was unrecorded. The City has no need for 99 feet of width so the new plat would establish a 66 <br />10 foot right of way. The proposed vacations are shown on the attached Vacation Exhibits (Attachment <br />11 D). New easements for sanitary sewer and drainage and utility easements would be established when <br />12 the final plat of The Enclave at McCarrons Lake is approved. <br />13 The vacation will be not be official until such time as the City Manager executes and records a <br />14 Notice of Completion of this vacation. This will be done once a Final Plat has been approved. <br />15 Therefore, staff is recommending the vacation of the right-of-way and easement vacations. <br />16 F INANCIAL I MPACTS <br />17 There is no financial impact to the City of Roseville. The property owner will need to enter into a <br />18 Public Improvement Contract with the City to realign the City’s sanitary sewer at their cost. All work <br />19 would need to be completed to the satisfaction of the City Engineer. <br />20 S TAFF R ECOMMENDATION <br />21 Staff recommends that the City Council approve the attached resolution approving the vacation of <br />22 the right-of-way and easements related to The Enclave at McCarrons Lake Plat. <br />23 R EQUESTED C OUNCIL A CTION <br />24 Conduct a public hearing receiving any public comments related to the proposed right-of-way and <br />25 easements vacations. <br />26 Consider approval of a resolution approving the vacation of right-of-way and easements related to <br />27 The Enclave at McCarrons Lake.
