REQUEST FOR COUNCIL ACTION <br /> Date: February 14, 2022 <br /> Item No.: 10.e <br />Department Approval City Manager Approval <br />Item Description: Approve Final Payment for Marion St. Pathway Improvements - Phase 1 <br />Page 1 of 2 <br />BACKGROUND 1 <br />On August 23, 2021, the City Council awarded the Marion Street Pathway – Phase 1 to Bituminous 2 <br />Roadways, Inc. Work completed under the contract totaled $66,272.60. The work was successfully 3 <br />completed during the 2021 season and the project is ready to be closed out. 4 <br />P-21-13 Marion Street Pathway – Phase 1: 8- to 10-foot bituminous pathway from the Marion Street 5 <br />cul-de-sac, running along the south and east sides of the Enclave at McCarrons development, up to 6 <br />South McCarrons Boulevard. 7 <br />City policy requires that the following items be completed to finalize a construction contract: 8 <br />• Certification from the City Engineer verifying that all of the work has been completed in 9 <br />accordance with plans and specifications. (See Attachment B) 10 <br />• A resolution by the City Council accepting the contract and beginning the one-year warranty. 11 <br />(See Attachment A) 12 <br />FINANCIAL IMPACTS 13 <br />The final contract amount, $66,272.60, is $40,110.90 (37.7%) less than the awarded amount of 14 <br />$106,383.50. Reduced costs included removing restoration from the contract, instead having that 15 <br />work performed in coordination with the Enclave at McCarrons development and City Public Works 16 <br />forces. 17 <br />Outside of the contract with Bituminous Roadways, Inc., this project included costs for testing and 18 <br />other miscellaneous expenses that totaled $1,030.50. 19 <br />The City was awarded Community Development Block Grant (CBDG) funds, which will fund the 20 <br />project. Costs will be paid from the Pathway Fund and reimbursed with the CDBG funds as they are 21 <br />received. 22 <br />STAFF RECOMMENDATION 23 <br />The work completed was in accordance with project plans and specifications. Staff recommends the 24 <br />City Council approve a resolution accepting the work completed as the Marion Street Pathway – 25 <br />Phase 1 and authorize final payment of $4,371.08 to Bituminous Roadways, Inc. 26
