REQUEST FOR COUNCIL ACTION <br />Date: February 28, 2022 <br />Item No.: 7.c <br />Department Approval City Manager Approval <br />Item Description: Consider Adopting Resolution Approving the Vacation of Right of Way <br />rd <br />Related to the Midland Legacy Estate 3 Addition Final Plat <br />1 70 C B ACKGROUND <br />2 On November 1, 2019, MnDOT released back to the City excess right-of-way (ROW) on County <br />3 Road B including right-of-way Parcel 303 E (Attachment C). As part of a proposed Midland Legacy <br />rd <br />4 Estate 3 Addition, the Developer, Integrity Land Development, has petitioned the City to vacate <br />5 this parcel, which is excess ROW located north of County Road B and east of Eustis Street. The <br />6 current ROW contains Eustis Street. The Developer plans to re-align County Road B and Eustis <br />7 Street to a more traditional 90-degree curve. This would allow for more land to be developed and <br />8 would allow for the vacation of the excess ROW. <br />9 This vacation of the ROW and re-alignment of County Road B and Eustis Street would also result in <br />10 the removal of the cul-de-sac where Eustis Street begins. Attachment E, a traffic memo, documents <br />11 staff support of removal of the cul-de-sac as it is not needed. <br />12 As seen on the attached proposed Final Plat, Attachment D, the new roadway alignment <br />13 (AttachmentF) would be established as part of the final plat approval process, including the public <br />14 improvement contract. The public improvement contract will have language requiring access for <br />15 residents be maintained during the re-alignment of the new roadway. <br />16 The vacation will not be official until such time the City Manager executes and records a Notice of <br />17 Completion of this vacation. This will be done once the Final Plat has been approved by the City <br />18 Council. Since the vacation was petitioned, only a majority Council vote is needed for approval. <br />19 No written public comments have been received to date. <br />20 F INANCIAL I MPACTS <br />21 There is no financial impact to the City of Roseville. <br />22 S TAFF R ECOMMENDATION <br />23 Staff recommends that the City Council adopt the attached resolution approving the vacation of the <br />24 excess ROW of County Road B and Eustis Street, former MnDOT right-of-way Parcel 303E, <br />25 Ramsey County, Minnesota. <br />26 R EQUESTED C OUNCIL A CTION <br />27 Conduct a public hearing receiving any public comments related to the proposed right-of-way <br />Page 1 of 2 <br /> <br />
