1 MEMORANDUM Attachment B <br />2 <br />3 <br />4 DATE:March7,2022 <br />5 <br />6 TO:CityManagerPatrickTrudgeon <br />7 <br />8 FROM:ChiefofPoliceErikaScheider <br />9 <br />10 SUBJECT:SummaryinformationonPoliceForfeiturefunds <br />11 <br />12 InAugustof2011,Councilrequestedanannualdocumentsummarizingforfeitureaccountactivities. <br />13 Theaccompanyingmemorandum,whichdescribesthePolice5ĻƦğƩƷƒĻƓƷ͸ƭforfeitureaccounts,serves <br />14 asfoundation. <br />15 <br />16 ThePoliceDepartmentforfeitureaccountsarelabeledas:FederalEquitableSharingNarcotics, <br />17 NarcoticsForfeiture,andAlcoholForfeiture. <br />18 <br />19 TheFederalEquitableSharingNarcoticsaccountholdsfundsforfeitedforfederalcontrolled <br />20 guidelines,equitablesharingfundsareno <br />substanceviolations.AsofJuly,2018,pernewfederal <br />21 longerdispersedtolocalagenciesasfundsareusedtosupporttaskforce(RamseyCountyViolent <br />22 CrimeEnforcementTeam)operations. <br />23 <br />24 TheNarcoticsForfeitureaccountholdsfundsforfeitedforcontrolledsubstanceoffensesandother <br />25 ͻķĻƭźŭƓğƷĻķƚŅŅĻƓƭĻƭͼͲasdefinedinMinnesotastatutes.In2020,theDepartmentcompleteda <br />26 comprehensivepolicyandproceduremanualrevision.Perpolicy,beginningin2021,theDepartment <br />27 nolongerpursuescashforfeituresunder$2,000duetotheunintended impactsonlowincome <br />28 communities. <br />29 <br />30 TheAlcoholForfeitureaccountholdsonlyfundsforfeitedforDWIrelatedoffenses.In2018,the <br />31 Departmentaltereditsoperatingproceduresonforfeitingvehicles.TheDepartmentwillonlyforfeit <br />32 vehiclesdriveninfelonyDWIoffensesandthosevehiclesmusthaveavalueofatleast$5,000. <br />33 <br />34 Thischangewasmadeforthefollowingreasons: <br />35 Forfeitingavehiclecanhaveunintendedanddisparateimpactsonfamiliesbasedonincome <br />36 levels. <br />37 Overthepastthreeyears,theDepartmentlostover$25,000forfeitingvehiclesduetoexpenses <br />38 andthelowreturnrateatauction,etc. <br />39 Accesstosecurestorageparkinglotsisexpensive. <br />40 RamseyCountyjudgesareincreasinglyrulinginfavorofinnocentownerclaims. <br />41 RamseyCountyjudgesarereturningvehiclestoarrestedpartiesandtheDepartmentis <br />42 mandatedtopaystoragecosts. <br />43 <br />44 <br />45 <br />46 <br />47 <br />48 <br /> <br />
