The CityOrdinancesasitpertainstoParkDedicationisas follows: <br />1103.06: PARK DEDICATION: <br />Authority:Minnesota Statutes 462.358,subdivisions 2b and 2c permits the <br />Citytorequirededicationofparkland,or cash inlieuof land, aspartofthe <br />subdivisionprocess in order tofulfillitsplansfor recreational facilitiesand <br />openspaces.The City Council, at itsdiscretion,willdetermine whether park <br />dedicationis required inthe form of land, cashcontribution,or a combination <br />of cash and land. Toproperlyuse this authority,the City willbase its <br />determinationonexistingdevelopment,theneedcreatedbytheproposed <br />development,andtheplansand policies ofthe City embodiedby the Parks and <br />RecreationSystemMaster Plan, PathwaysMaster Plan, andComprehensive <br />Plan. <br />Conditionto Approval: Park dedication willbe required asaconditionto <br />theapprovalof any subdivision.The Parks and <br />RecreationCommissionshall recommend, inaccordance with Statute and after <br />consultingtheapprovedplansand policies notedherein,either a portionof <br />landto bededicatedtothepublic,or in lieu thereof, acashdepositgiventothe <br />Citytobeusedfor park purposes,or a combinationofland and cash deposit. <br />ParkDedicationAmount: The portion of land tobe dedicated inall areas <br />shallbe10%Parkdedicationfees shall be reviewed anddeterminedannually <br />byCityCouncilresolutionand established inthe fee schedule inChapter314 <br />ofthisCode,andthe fee shall bepaidas part of the Development Agreement <br />required in Section1102.05ofthisTitle. <br />UtilityDedicationsNot Qualified: Landdedicatedfor required <br />street right-of-wayor utilities, includingdrainage,doesnotqualifyas park <br />dedication.(Ord.1530,7/10/2017) <br />FEES <br />ParkDedication fees are set annually byresolution of the City Council as <br />part ofthe fee schedule.Currently,the amount issetat$4,250 per unit.For <br />non-residential,the fee is calculated as10% of the fair market valueof the <br />property. <br /> <br />
