The CityOrdinancesasitpertainstoParkDedicationisas follows: 1103.06: PARK DEDICATION: Authority:Minnesota Statutes 462.358,subdivisions 2b and 2c permits the Citytorequirededicationofparkland,or cash inlieuof land, aspartofthe subdivisionprocess in order tofulfillitsplansfor recreational facilitiesand openspaces.The City Council, at itsdiscretion,willdetermine whether park dedicationis required inthe form of land, cashcontribution,or a combination of cash and land. Toproperlyuse this authority,the City willbase its determinationonexistingdevelopment,theneedcreatedbytheproposed development,andtheplansand policies ofthe City embodiedby the Parks and RecreationSystemMaster Plan, PathwaysMaster Plan, andComprehensive Plan. Conditionto Approval: Park dedication willbe required asaconditionto theapprovalof any subdivision.The Parks and RecreationCommissionshall recommend, inaccordance with Statute and after consultingtheapprovedplansand policies notedherein,either a portionof landto bededicatedtothepublic,or in lieu thereof, acashdepositgiventothe Citytobeusedfor park purposes,or a combinationofland and cash deposit. ParkDedicationAmount: The portion of land tobe dedicated inall areas shallbe10%Parkdedicationfees shall be reviewed anddeterminedannually byCityCouncilresolutionand established inthe fee schedule inChapter314 ofthisCode,andthe fee shall bepaidas part of the Development Agreement required in Section1102.05ofthisTitle. UtilityDedicationsNot Qualified: Landdedicatedfor required street right-of-wayor utilities, includingdrainage,doesnotqualifyas park dedication.(Ord.1530,7/10/2017) FEES ParkDedication fees are set annually byresolution of the City Council as part ofthe fee schedule.Currently,the amount issetat$4,250 per unit.For non-residential,the fee is calculated as10% of the fair market valueof the property.
