37 adopting an interim ordinance (commonoly known as a moratorium) prohibiting the sale, <br />38 manufacturing or distribution of cannabinoids in order to study the issue should be considered. A <br />39 moratorium is limited to a period of one year and the City Council must authorize a study to be <br />40 conducted on the issue.After the review and study of the issue, staff would bring forward further <br />41 recommendations, and the City Council could choose to enact regulations or an enact a prohibition <br />42 regarding the sale, manufacturing, an distribution of THC products. <br />43 <br />44 In order forCouncil to consider adopting a moratorium at the August 8, 2022 meeting, the interim <br />45 ordinance must be published under the 10-day publication requirement for all ordinances, in addition <br />46 a public hearing is required prior to adoption. The interim ordinance has been published in <br />47 accordance with the 10-day requirement and notice has been provided that a Public Hearing to <br />48 consider this item will occur. <br />49 P OLICY O BJECTIVE <br />50 Local governments are delegated authority from the state to protect the public health, safety and <br />51 general welfare of their residents. <br />52 E QUITY I MPACT <br />53 At this time, a full analysis cannot be conducted until further direction has been provided. However, <br />54 studies have shown that there are some communities that have experienced a disproportionate, <br />55 negative impact from cannabis regulation enforcement. For example, Black Americans are arrested <br />1 <br />56 for cannbis offenses at a rate of nearly 4:1, compared to whites. Consideration should be given to <br />57 the impacts of violations, or penalties of any furture regulations and how that may or may not impact <br />58 various communities. <br />59 B UDGET I MPLICATIONS <br />60 None at this time until further direction is provided. <br />61 S TAFF R ECOMMENDATION <br />62 1.
