1 City of Roseville <br />2 ORDINANCE NO. _____ <br />3 <br />4 <br />5 AN INTERIM ORDINANCE IMPOSING A TEMPORARY <br />6 MORATORIUM ON THE SALE, MANUFACTURING, AND <br />7 DISTRIBUTION OF EDIBLES AND BEVERAGES INFUSED WITH <br />8 TETRAHYDROCANNIBINOL (THC) <br />9 <br />10 <br />11 <br />12 THE CITY OF ROSEVILLE ORDAINS: <br />13 <br />14 SECTION 1: PURPOSE AND INTENT <br />15 <br />16 The City of Roseville recognizes the significant public interest and concern <br />17 regarding recent State of Minnesota legislation legalizing the sale of certain <br />18 products, including edibles and beverages, infused with <br />19 tetrahydrocannabinol (THC). The City desires to regulate the sale of such <br />20 products in a manner that is consistent to public health, welfare, and safety, <br />21 as well as in accordance with the City’s interest in fairness and due process <br />22 toward potential future retail establishments and purveyors of such <br />23 products. <br />24 <br />25 Given the abrupt nature of the Legislature’s passage of relevant law and the <br />26 significant public interest and concern resulting therefrom, the City further <br />27 recognizes that the specific contours of such regulation have not yet been <br />28 vetted with appropriate diligence. <br />29 <br />30 Minnesota Statutes Section 462.355, subd. 4, permits municipalities to <br />31 implement a moratorium on certain land uses within its jurisdiction to allow <br />32 for the completion of appropriate study and subsequent adoption of relevant <br />33 land use controls. State law permits such moratoria to persist for a period of <br />34 up to twelve (12) months. <br />35 <br />36 The City hereby concludes that additional study and research is required to <br />37 formulate and adopt appropriate regulations governing the sale, <br />38 manufacturing and distribution of edibles and beverages infused with THC <br />39 within its jurisdiction. <br />40 <br />41 Therefore, the City finds that a moratorium on the sale, manufacturing and <br />42 distribution of edibles and beverages infused with THC is necessary to <br /> <br />
