Attachment A <br />29 S TAFF R EVIEW OF R AMSEY C OUNTY HHWIU <br />30 An applicant seeking approval of an IU, or its renewal, is required to hold an open house meeting <br />31 to inform the surrounding property owners, renters, and other interested attendees of the <br />32 proposal, to answer questions and to solicit feedback. Ramsey County Public Health held the <br />33 open house for the HHW site on March 22, 2022, and no citizens were in attendance, either <br />34 virtual or in-person. Ramsey County Public Health did receive two emails, which conversations <br />35 are included on the Open House Summary (Attachment E). <br />36 R EVIEW OF IUC RITERIA <br />37 §1009.03 D of the City Code specifies that three specific findings must be made in order to <br />38 approve a proposed INTERIM USE: <br />39 a. The proposed use will not impose additional costs on the public if it is necessary for the <br />40 public to take the property in the future. This is generally intended to ensure the particular <br />41 interim use will not make the site costly to clean up if the City were to acquire the property <br />42 for some purpose in the future. Although the use specifically involves hazardous waste, the <br />43 types and quantities are of a household nature and scale and the facility is built and operated <br />44 to protect against spillage of these materials. A public entity already owns the property and <br />45 Planning Division staff believes the operation of the HHW collection site is done in a manner <br />46 that adequately protects it from contamination. <br />47 b. The proposed use will not create an excessive burden on parks, streets, and other public <br />48 facilities. With an average of 150 vehicles visiting the HHW collection site on its operational <br />49 days, this traffic is well within the capacity of Larpenteur Avenue, the roadway intersecting <br />50 with Kent Street. Planning Division staff finds the waste collection use is conducted and <br />51 located in a way that has no effect on other public facilities. <br />52 c. The proposed use will not be injurious to the surrounding neighborhood or otherwise harm <br />53 the public health, safety, and general welfare. The HHW collection use has operated <br />54 periodically for nearly 25 years and Community Development staff are unaware of any <br />55 complaints having been made about the use during that time. Planning Division staff finds <br />56 the continuation of the use in the same conscientious manner will ensure that it does not <br />57 injure the public health, safety, and general welfare. <br />58 P UBLIC C OMMENT <br />59 Aside from the information provided as a component of the open house, the Planning Division <br />60 has not received any comments as of the writing of this report. <br />61 S TAFF R EVIEW AND R ECOMMENDATION <br />62 In review of the existing IU for the HHW collection facility operated by Ramsey County, <br />63 Planning Division staff find the existing condition of approval, noted below, demands additional <br />64 discussion: <br />65 The HHW collection use shall be administratively reviewed on an annual basis on the <br />66 anniversary date of the resolution granting the renewed INTERIM USE approval, with a <br />67 staff report submitted to the Planning Commission and City Council as needed to address <br />68 operational or maintenance issues that may arise. <br />PF22-003_RPCA_RamseyCountyHHW_050422 <br />Page 2 of 3 <br /> <br />
