Attachment A <br />1 3. Storm sewer construction: The Developer shall construct all storm sewer improvements <br />2 determined to be necessary by the City to serve the Property, including the construction <br />3 of outlet control structures and flared end sections. <br />4 a)Storm sewer facilities, including ponds and bioretentionbasins, shall be constructed <br />5 in accordance with City details, specifications, and the City approved Public <br />6 Improvement Construction Plans. <br />7 b) Bioretention basins shall be protected from silt during construction. If these areas do <br />8 not function as designed, the Developer shall reconstruct them as directed by the City <br />9 Engineer. <br />10 c)All storm sewer improvements shall be private with the exception any storm sewer <br />11 located within the Eustis Street or County Road B right-of-way as shown in the Grading <br />12 and Drainage Plan attached as Exhibit C. <br />13 d) The Homeowners’ Association shall have ownership and maintenance obligations for <br />14 the private storm sewer improvements. A Stormwater Operations and Maintenance <br />15 Agreement and Stormwater Operations and Maintenance Plan are required. <br />16 <br />17 E.Development Plans. The Property shall be developed in accordance with the following plans, <br />18 specifications and other documents (“Plans”). With the exception of the Plat, the Plans may be <br />19 prepared after the parties have entered into this Agreement, provided however, no work shall be <br />20 commenced on the Property until all of the Plans have been submitted to and approved by the City. <br />21 The Plans shall not be attached to this Agreement, but shall be retained in the City files while the <br />22 work to be done under this Agreement is being performed. If the Plans vary from the written terms <br />23 of this Agreement, the written terms shall control. The Plans (which are sometimes referred to <br />24 herein as the “Public Improvement Construction Plans”) are as follows: <br />rd <br />25 a)Midland Legacy Estate 3 Addition Final Plat; <br />rd <br />26 b) Midland Legacy Estate 3 Addition Plan Set; and <br />27 c)Storm Water Maintenance Agreement. <br />28 F. Notice to Proceed.The improvements shall be installed in accordance with the City approved Plans <br />29 and the rules, regulations, standards and ordinances of the City. The plans and specifications shall <br />30 be prepared by a competent registered professional engineer, furnished to the City for review, and <br />31 shall be subject to the approval of the City Engineer. No work shall commence on the Property until <br />32 the City Engineer notifies the Developer that the work can commence. <br />33 1. The Developer shall obtain all necessary permits from the Minnesota Pollution Control <br />34 Agency (MPCA), Minnesota Department of Health (MDOH), applicable watershed, all <br />35 City permits, including erosion control, grading and storm water permit and other <br />36 agencies and governmental authorities before proceeding with construction. Copies of <br />37 these permits must be provided to the City Engineer. <br />38 2. The Developer or its engineer shall schedule a preconstruction meeting at a mutually <br />39 agreeable time at City Hall with all the parties concerned, including City staff, to review <br />40 the program for the construction work. <br />Page 4 of 17 <br /> <br /> <br />
