REQUEST FOR COUNCIL ACTION <br />Date: July 25, 2022 <br />Item No.: .b <br />Department Approval City Manager Approval <br />Item Description: Review and Consider an Ordinance Amending City Code Chapter 309: Massage <br />Therapy <br />1 B ACKGROUND <br />2 In November, 2021 staff brought forward an ordinance amending City Code Chapter 309: Massage <br />3 Therapy with the recommendation to reduce the number of Massage Therapy Establishment licenses to <br />4 a total of ten (10) licenses, in addition other changes that made the owner of an establishment <br />5 responsible to assure that all therapists employed are licensed by the City of Roseville. At that meeting, <br />6 Council decided to limit the number of establishments to twenty-five (25), which at that time were the <br />7 number of licensed establishments operating within the City, with the intent to bring back further <br />8 discussion. <br />9 <br />10 The city currently has 24 license massage therapy establishments since one establishment chose not to <br />11 renew their license in 2022. Attached is a list of these establishments as well as information regarding <br />12 the number of establishment licenses for other cities. <br />13 <br />14 With the amount of massage therapy establishments and licensed massage therapists operating in the <br />15 city, staff has found it extremely difficult to properly regulate and monitor massage therapy <br />16 establishment operations, and individual massage therapist licenses. In addition, criminal activity <br />17 including willfully ignoring licensing requirements, sexual assaults perpetrated by massage therapy <br />18 establishment employees, and suspected human trafficking have occurred at Roseville establishments in <br />19 the past. As a result, staff has been reviewing the current Massage Therapy Establishment ordinance. <br />20 <br />21 The drafted ordinance has been posted in accordance with the 10-day rule, and has been sent to each of <br />22 the current license holders. The drafted ordinance does not indicate the specific number of allowed <br />23 licenses and council is being asked to determine this number as part of the discussion. In addition, <br />24 language has been added to clarify what happens if a license is sold or transferred which is similar to <br />25 how our tobacco license ordinance reads. <br />26 <br />27 The proposed ordinance also provides some updated language to align with our current practice of <br />28 utilizing a third party to conduct criminal background checks for massage therapy establishments and <br />29 individual therapists. <br />30 F INANCIAL I MPACTS <br />31 Limiting the amount of establishment licenses will reduce the amount of revenue collectedbut also <br />32 expenses for granting licenses for massage therapy establishments and subsequently individual massage <br />33 therapists. <br />Page 1 of 2 <br /> <br />
