Regular City Council Meeting <br />Monday, August 8, 2022 <br />Page 5 <br />Mr. Trudgeon indicated that is correct. He noted one of the CityÓs interests is to <br />make sure that access is limited to persons twenty-one or older and right now the <br />City does not have any mechanism in place to verify that. This is another reason <br />why the City needs to have some type of regulation on the books so the City can <br />enforce, educate, and make sure all retailers are following the law as it was directed. <br /> <br />Mayor Roe asked how that gets accomplished with the tobacco and alcohol licens- <br />ing. <br /> <br />Mr. Trudgeon indicated staff does compliance checks twice a year. <br /> <br />Councilmember Strahan indicated for clarification, the only establishment that <br />could not sell these products under the new State law is liquor stores so one of the <br />few twenty-one plus entities and anyone else could sell THC products otherwise. <br /> <br />Mr. Trudgeon indicated that was correct. <br /> <br />Mayor Roe reviewed public hearing protocol and opened the public hearing at ap- <br />proximately 6:42 p.m. <br /> <br />Public Comment <br />Mr. Cap OÓRourke <br />Mr. OÓRourke indicated he was at the meeting representing many of the small busi- <br />nesses throughout the State that are currently selling the products. He explained <br />the Council should have received a document in email from Sensible Change Min- <br />nesota. He showed a chart in the document. He explained prior to July 1, 2022 <br />there were essentially three types of products on the market. There were products <br />that had CBD, THC Delta Nine, and products that had THC with other isomers as <br />well as other food and beverages on the market. CBD was fully Federally legal and <br />fully State legal and could be purchased almost anywhere. THC Delta Nine was <br />Federally legal if it had less than .3 percent of THC and per a court ruling, it was <br />supposed to be State legal but there was an interpretation by a court that some prod- <br />ucts would be a felony charge. There was also the other THC products that are <br />fully Federally legal and there was no State law prohibiting them. Last fall, the <br />Minnesota Board of Pharmacy said that they felt some of these products were in- <br />toxicating and, therefore, should not be sold. There is not a specific Statute and the <br />Board of Pharmacy never took action on any retailer selling them. The new law <br />passed that basically treated all THC the same and it has to have less than .3 percent <br />of any product. Edibles and food and beverage have to have less than 5 mg and <br />less than 50 mg. All of these products have been sold in the City of Roseville for <br />over two years. He explained this new law actually restricted what was available. <br />There were products that had higher levels of Delta Eight and Delta Ten. Delta <br /> <br />
