REQUEST FOR COUNCIL ACTION <br />Date: October 24, 2022 <br />Item No.:7.d <br />Department ApprovalCity Manager Approval <br />Item Description:Consideranordinancepertaining to tenant notificationand approve a <br />summary publication <br />1 B ACKGROUND <br />2 The legislative history and/or important events for the proposed Tenant Notification ordinance is as <br />3 follows: <br />4 September 20, 2021: The REDA held a meeting and discussed information related to Just <br />5 Cause, Inclusionary Housing, and Tenant Notification ordinances. Staff was provided <br />6 direction to pursue a Tenant Notification ordinance in 2022. <br />7 May 16, 2022: The REDAheld a meeting and received information regarding a process that <br />8 was to be followed in order to engage with the public in advance of formal ordinance <br />9 consideration. The process was defined based on completion of the City’s Racial Equity <br />10 Toolkit. This discussion also noted that future ordinance considerationwould occur at the City <br />11 Council. Since that meeting, City staff drafted and executed anengagement plan. <br />12 Mid-August thru September, 2022: Various engagement efforts were held to inform renters, <br />13 applicable property owners and managers of multi-family housing, and housing advocates of <br />14 the proposed tenant notification ordinance. These efforts resulted in informing every rental <br />15 unit of the proposed ordinance and 104 meaningful engagement interactions to gain feedback. <br />16 October 17, 2022: The City Council discussed the results of the engagement that occurred <br />17 relative to the proposed ordinance, directed staff to make revisions to the ordinance,then to <br />18 bring the ordinanceforward for adoption at the October 24, 2022 City Council meeting. <br />th <br />19 Since the October 17meeting, staff has revised the ordinance based on the following direction from <br />20 Council: <br />21 Amended the title of the ordinance to state it applies to licensed multi-family buildings <br />22 containing 5 or moreunits, and <br />23 Amended the purpose statement of the ordinance to state it applies to licensed multi-family <br />24 buildings containing 5 or more units, and <br />25 Retained the Notice to the City of Proposed Sale requirement for affordable housing buildings <br />26 based on the Council’s agreement to request rent amountsas a component of license <br />27 application, recognizing most apartment buildings in the City will meet an affordability <br />28 threshold of80% AMIas dictated by HUD. <br />Page 1of 2 <br /> <br />
