<br />146 (c) Action. The City Council may either approve or deny the application for a license, or it may <br />147 delay action for a reasonable period of time as necessary to complete any investigation of the <br />148 application or the applicant it deems necessary. If the City Council approves the license, the City <br />149 Clerk shall issue the license to the applicant. If the City Council denies the license, notice of the <br />150 denial shall be given to the applicant along with notice of the applicant's right to appeal the City <br />151 Council's decision. If a license application is denied, the earliest an applicant may reapply is 12 <br />152 months from the date the license is denied. <br />153 <br />154 (d) Term. All licenses issued under this article shall expire on December 31 of each year. <br />155 <br />156 (e) Revocation or Suspension. Any license issued under this article may be revoked or suspended <br />157 as provided in Section 316.10. <br />158 <br />159 (f) Transfers. All licenses issued under this article shall be valid only on the premises for which <br />160 the license was issued and only for the person or business to whom the license was issued. The <br />161 transfer of any license to another location, business, or person is prohibited. <br />162 <br />163 (g) Display. All licenses shall be posted and displayed in plain view of the general public on the <br />164 licensed premises. <br />165 <br />166 (h) Renewals. The renewal of a license issued under this article shall be handled in the same <br />167 manner as the original application. <br />168 <br />169 (i) Issuance as Privilege and Not a Right. The issuance of a license issued under this article is a <br />170 privilege and does not entitle the license holder to automatic renewal of the license. <br />171 <br />172 (j.) Total Licenses. The total number of licenses for Tetrahydrocannabinol Products shall not <br />173 exceed _______ <br />174 <br />175 Section 316.04 FEES. <br />176 No license shall be issued under this Chapter until the appropriate license fee has been paid in full. <br />177 The fee for a license under this Chapter shall be established by the City Council and adopted in <br />178 the City fee schedule, and may be amended from time to time. License fees are pro-rated on a <br />179 quarterly basis as defined in Chapter 301.04. <br />180 <br />181 Section 316.05 INELIGIBILITY AND BASIS FOR DENIAL OF LICENSE. <br />182 (a) Ineligibility. <br />183 (1) Moveable Place of Business. No license shall be issued to a moveable place of business. <br />184 Only fixed location businesses shall be eligible to be licensed under this article. <br />185 (2) Exclusive Liquor Store. No license shall be issued to an exclusive liquor store as defined <br />186 in Minnesota Statutes, section 340A.101, subdivision 10. <br />187 <br />188 (b) Grounds for Denial. Grounds for denying the issuance or renewal of a license under this <br />189 Chapter include, but are not limited to, the following: <br />190 (1) The applicant is under the age of 21 years. <br />191 <br />192 (2) The applicant is prohibited by Federal, State, or other local law, ordinance, or other <br />193 regulation from holding a license. <br />194 <br /> Underline reflects new language <br /> <br />
