REQUEST FOR COUNCIL ACTION <br />Date:January 9, 2023 <br />Item No.:10.j <br />Department ApprovalCity Manager Approval <br />Item Description:Adopt Resolution Approving Agreement with the Minnesota Department of <br />Transportation for Federal Aid Participation <br />1 B ACKGROUND <br />2 The City of Roseville currently has an agreement (No 1029999) executed in 2018 with the <br />3 Minnesota Department of Transportation (MnDOT) to act as the Local Government’s agent when <br />4 accepting federal funds. This allows MnDOT the ability, as required by the Federal Highway <br />5 Administration (FHWA), to review all project expenses, bidding requirements, etc. to ensure they <br />6 meet the requirements of federal funding. MnDOT wants to update this agreement with a new <br />7 agreement. <br />8 The new agreement (Attachment B) would supersede the previous agreement. Pursuant to <br />9 Minnesota Stat. Sec. 161.36, the Commissioner of Transportation must be appointed as Agent of the <br />10 City of Rosevilleto accept, as its agent, federal aid funds which may be made available for eligible <br />11 transportation related projects. <br />12 This agreement will allow the City to complete projects with federal funds and meet all requirements <br />13 from the FHWA on the expenditure of those funds. According to the resolution, the Mayor and the <br />14 City Manager are hereby authorized and directed for and on behalf of the City to execute and enter <br />15 into an agreement with the Commissioner of Transportation prescribing the terms and conditions of <br />16 said federal aid participation as set forth and contained in “Minnesota Department of Transportation <br />17 Agency Agreement No. 1029999.” <br />18 The agreement has no expiration date other than a 30-day written notice of either party. <br />19 P OLICY O BJECTIVE <br />20 It is City policy to keep City-owned infrastructure in good operating condition and to keep systems <br />21 operating in a safe condition. <br />22 B UDGET I MPLICATIONS <br />23 There are no budget impacts associated with this resolution. <br />24 R ACIAL E QUITY I MPACT S UMMARY <br />25 This policy should have no equity impactssince this agreement is not specific to any project. <br />26 S TAFF R ECOMMENDATION <br />27 Approve resolution Approving Agreement with the Minnesota Department of Transportation for <br />28 Federal Aid Participation. <br />Page 1of 2 <br /> <br />
