Regular City Council Meeting
Monday, November 28, 2022
Page 7
Addition", creating a residential lot from an outlot and an abutting residential lot;
with no one appearing for or against.
Mayor Roe asked if the applicant wished to address the City Council.
Mr. David Knaeble, Engineer with Civil Sight Group, addressed the Council, indi-
cating he was available to answer questions but had nothing to add to the request
as presented.
Willmus moved, Etten seconded, denial of the proposed "Weaton Woods 2nd Ad-
dition"Plat because it does not conform with LDR lot standards and does not align
with the standards in the Subdivision Code.
Council Discussion
City Attorney Gaughan wondered if the motion proposer finds that the variance
does not conform to the four pre-requisite standards within the provisions for vari-
ance in City Code.
Councilmember Willmus concurred. He thought some of the conversations made
before them with respect to the setbacks and variance and possibly amending the
variance over concern about what could or potentially be built and some of the
problems that align with that. He explained the City has just gone through a devel-
opment of the new Code and new Comp. Plan and the tools that go along with that.
He not feel that it was necessary to make this deviation in essence of shoehorning
in a home on a substandard lot. He indicated that is basis for his motion.
Councilmember Etten concurred.
Mayor Roe thought if the Council felt there could be a change to this to meet the
City's requirements, it is potentially possible to table this action. He noted the
deadline for City action is January 27,2023,so there is the possibility for something
to be brought back.
Original motion, as amended by the makers per the clarification from the City At-
torney: Willmus moved, Etten seconded, denial of the proposed "Weaton Woods
2nd Addition" Plat and variance because it does not conform with LDR lot stand-
ards and does not align with the standards in the Subdivision Code and does not
conform to the four prerequisite standards within the provisions for variance in City
Code.
Roll Call
Ayes: Groff, Willmus, Strahan, Etten, and Roe.
Nays: None.
