Attachment <br />Proposed Shoreland Ordinance Update <br />5311 i. The screening of structures, vehicles, or other facilities as viewed from the water, <br />5312 assuming summer, leaf-on conditions, is not substantially reduced; <br />5313 ii. Existing shading of water surfaces along rivers is preserved; <br />5314 iii. Cutting debris or slash shall be scattered and not mounded on the ground; and <br />5315 iv. Perennial ground cover is retained. <br />5316 v. Picnic areas, access paths, livestock watering areas, beaches and watercraft access areas <br />5317 are prohibited in bluff impact zones. <br />5318 d. Removal of trees, limbs, or branches that are dead, diseased, dying, or pose safety hazards is <br />5319 allowed without a permit. <br />5320 e. Fertilizer and pesticide runoff into surface waters must be minimized through use of <br />5321 vegetation, topography or both. <br />5322 3. Grading and Filling <br />5323 a. Grading and filling activities must comply with the provisions of this subsection except for <br />5324 the construction of public roads and parking areas if consistent with Section 1012.03.G.1 of <br />5325 this ordinance. <br />5326 b. Permit Requirements <br />5327 i. Grading, filling and excavations necessary for the construction of structures, and <br />5328 driveways, if part of an approved permit, do not require a separate grading and filling <br />5329 permit. However, the standards in Section 1017.08.B.3 of this ordinance must be <br />5330 incorporated into the permit. <br />5331 ii. For all other work, including driveways not part of another permit, a grading and filling <br />5332 permit is required for: <br />5333 A. The movement of more than 10 cubic yards of material on steep slopes or within <br />5334 shore or bluff impact zones; and <br />5335 B. The movement of more than 50 cubic yards of material outside of steep slopes and <br />5336 shore and bluff impact zones. <br />5337 c. Grading, filling and excavation activities must meet the following standards: <br />5338 i. Grading or filling of any wetland must meet or exceed the wetland protection standards <br />5339 under Minnesota Rules, Chapter 8420 and any other permits, reviews, or approvals by <br />5340 other local state, or federal agencies such as watershed districts, the DNR or US Army <br />5341 Corps of Engineers; <br />5342 ii. Land alterations must be designed and implemented to minimize the amount of erosion <br />5343 and sediment from entering surface waters during and after construction consistently by: <br />5344 A. Limiting the amount and time of bare ground exposure; <br />5345 B. Using temporary ground covers such as mulches or similar materials; <br />5346 C. Establishing permanent, deep-rooted and dense vegetation cover as soon as possible; <br />26 <br /> <br />
