Attachment <br />Proposed Shoreland Ordinance Update <br />574 N. <br />575 NATURAL GRADE: The grade of a site before it is modified by moving earth, adding or removing fill, <br />576 or installing a berm, retaining wall or other earthwork feature. Natural grade is determined by reference to <br />577 a survey, or other information as determined by the zoning administrator. <br />578 NONCONFORMING, ILLEGAL: Designates a lot, use, or structure which failed to satisfy all applicable <br />579 zoning requirements and was, therefore, illegally established when it was created, initiated, or constructed <br />580 and which currently fails to satisfy all applicable requirements of this Title as amended. <br />581 NONCONFORMING, LEGAL: Designates a lot, use, or structure which satisfied all applicable zoning <br />582 requirements when it was created, initiated, or constructed but which currently fails to satisfy all <br />583 applicable requirements of this Title as amended. <br />584 NON-MOTORIZED PATHWAYS: On-road and off-road pathways which are used for pedestrian, <br />585 bicycle, and other non-motorized means of transportation, the specifications of which shall be established <br />586 by the Public Works Director. <br />587 NOXIOUS MATTER: Material which is capable of causing injury or malaise to living organisms or is <br />588 capable of causing detrimental effect upon the health or the psychological, social or economic well-being <br />589 of human beings. <br />590 NURSERY SCHOOL: A public or private facility, licensed by the state, the principal function of which is <br />591 to provide an educational experience outside of the family home for children of preschool age. <br />592 NURSING HOME: A state-licensed establishment having accommodations for the continuous care of two <br />593 or more invalid, infirm, aged convalescent patients, or disabled persons that are not related. <br />594 O. <br />595 OFFICE: The general use of a building for administrative, executive, professional, research, or similar <br />596 organizations having only limited contact with the public. Office is characterized by a low proportion of <br />597 vehicle trips attributable to visitors or clients in relationship to employees. Examples include, but are not <br />598 limited to, firms providing architectural, computer software consulting, data management, engineering, <br />599 interior design, graphic design, or legal services. (Ord. 1572, 06-03-2019) <br />603 OVERLAY DISTRICT: A zoning district that encompasses one or more primary zoning districts or <br />604 portions thereof and that imposes additional requirements or relaxes one or more standards required by the <br />605 primary zoning district. <br />606 ORDINARY HIGH WATER LEVEL: The point on the bank or shore up to which the presence and action <br />607 of surface water is so continuous as to leave a distinctive mark such as by erosion, destruction or <br />608 prevention of terrestrial vegetation, predominance of aquatic vegetation, or other easily recognized <br />609 characteristic.The boundary of public waters and wetlands, and shall be an elevation delineating the <br />610 highest water level which has been maintained for a sufficient period of time to leave evidence upon the <br />611 landscape, commonly that point where the natural vegetation changes from predominantly aquatic to <br />3 <br /> <br />
