RCA Attachment A 643 i. The screening of structures, vehicles, or other facilities as viewed from the water, 644 assuming summer, leaf-on conditions, is not substantially reduced; 645 ii. Existing shading of water surfaces along rivers is preserved; 646 iii.Cutting debris or slash shall be scattered and not mounded on the ground; and 647 iv. Perennial ground cover is retained. 648 v. Picnic areas, access paths, livestock watering areas, beaches and watercraft access areas 649 are prohibited in bluff impact zones. 650 d. Removal of trees, limbs, or branches that are dead, diseased, dying, or pose safety hazards is 651 allowed without a permit. 652 e. Fertilizer and pesticide runoff into surface waters must be minimized through use of 653 vegetation, topography or both. 654 3. Grading and Filling 655 a. Grading and filling activities must comply with the provisions of this subsection except for 656 the construction of public roads and parking areas if consistent with Section 1012.03.G.1 of 657 this ordinance. 658 b. Permit Requirements 659 i. Grading, filling and excavations necessary for the construction of structures, and 660 driveways, if part of an approved permit, do not require a separate grading and filling 661 permit. However, the standards in Section 1017.08.B.3 of this ordinance must be 662 incorporated into the permit. 663 ii. For all other work, including driveways not part of another permit, a grading and filling 664 permit is required for: 665 A. The movement of more than 10 cubic yards of material on steep slopes or within 666 shore or bluff impact zones; and 667 B. The movement of more than 50 cubic yards of material outside of steep slopes and 668 shore and bluff impact zones. 669 c.Grading, filling and excavation activities must meet the following standards: 670 i. Grading or filling of any wetland must meet or exceed the wetland protection standards 671 under Minnesota Rules, Chapter 8420 and any other permits, reviews, or approvals by 672 other local state, or federal agencies such as watershed districts, the DNR or US Army 673 Corps of Engineers; 674 ii. Land alterations must be designed and implemented to minimize the amount of erosion 675 and sediment from entering surface waters during and after construction consistently by: 676 A. Limiting the amount and time of bare ground exposure; 677 B. Using temporary ground covers such as mulches or similar materials; 678 C. Establishing permanent, deep-rooted and dense vegetation cover as soon as possible; Page 23 of 32
