REQUEST FOR COUNCIL ACTION <br />Date:February 13, 2023 <br />Item No.:7.h <br />Department ApprovalCity Manager Approval <br />Item Description: Continuation: Consider issuance of a Short-TermRental License for 1901 Ryan <br />Ave. <br />1 B ACKGROUND <br />2 This item was originally discussed during the January 30, 2023 City Council meeting. Typically, short- <br />3 term rental licenses are deemed procedural (either requirements are met or they aren’t) and acted upon <br />4 as a part of the Council’s consent agenda. This license request was pulled from the consent agenda as <br />5 the Council had questions for the property owner, ultimately requestingadditional information prior <br />6 to taking action on the license request. Staff contacted the property owner with those questions and <br />7 was provided responses, which can be foundin Attachment C. It should also be noted that the <br />8 applicant obtained the appropriate rental registration five days after purchasing the home, so regular <br />9 rentals have been occurring, which are in compliance withCity requirements. <br />10 Chapter 909 of City Code requires the licensing of non-owner occupied short-term rentals of dwelling <br />11 units, subject to certain exemptions. On December7, 2022, an application for a short-term rental <br />12 license was submittedby the property owner. The property is a threebedroom, single family home. <br />13 The property owner has certified and attested to the requirement of lodging tax payment, as well as, <br />14 the maximum occupancy of four or less unrelated adults or one family.There have been no nuisance <br />15 or property maintenance violations in the last five yearsthat impact the ability of the license to be <br />16 issued. Short-term rental licenses include the requirement of minimum stays based on on-season (10 <br />17 days) and off-season (7 days) times of the year. <br />18 Upon issuance,the license will be valid for 365 days from issue date. A current copy of the license <br />19 must be posted in the rental unit, along with current copies of City Code Sections 405, 407 and 602. <br />20 A draft of the license is provided as Attachment B. <br />21 The applicant has supplied all required license information and paid the license fee of $515. In <br />22 accordance with Section 909.03, the process for licensure is outlined in Chapter 301, which requires <br />23 presentation to the City Council. Based upon the requirements outlined in ordinance, the property <br />24 owner is entitled to the license. <br />25 P OLICY O BJECTIVE <br />26 Licensing required by Section 909, effective as of February 8, 2021. <br />27 B UDGET I MPLICATIONS <br />28 The correct fees were paid to the City at the time of application submittal. <br />Page 1of 2 <br /> <br />
