Attachment B <br />REQUEST FOR PLANNING COMMISSION ACTION <br />Agenda Date: 02/01/23 <br />AgendaItem:6a <br />Department Approval Agenda Section <br />Public Hearings <br />tem Description: Continuation to consider a Request by AUNI Holdings in coordination <br />with FedEx for a Conditional Use to allow a parking lot as a principal use <br />at 2373 and 2395 County Road C2 (PF22-015) <br />Њ A PPLICATION I NFORMATION <br />Ћ Applicant:AUNIHoldings <br />Ќ Location: 2373 & 2395 County Road C2 <br />Ѝ Application Submission: 11/28/22; deemed complete 12/08/22 <br />Ў City Action Deadline: January 26, 2023 <br />Џ Extended to March 27, 2023 <br />А Zoning: Corridor Mixed-Use (MU-3) District <br />Б L EVEL OF D ISCRETION IN D ECISION M AKING: Action taken on a conditional use proposal is <br />В quasi-judicial; the CityÓs role is to determine the facts associated with the request, and apply <br />ЊЉ those facts to the legal standards contained in State Statute and City Code. <br />ЊЊ B ACKGROUND <br />ЊЋ This item was continued at the January 4, 2023, <br />ЊЌ Planning Commission meeting due to an incorrect site <br />ЊЍ plan; meeting minutes can be found as Attachment C. <br />ЊЎ Since the January meeting, the Planning Division <br />ЊЏ received a revised site plan, which has been reviewed <br />ЊА by the City staff whose comments are included in the <br />ЊБ following review. <br />ЊВ AUNI Holdings, owner of 2929 Long Lake Road, <br />ЋЉ recently executed a lease with FedEx to occupy and make <br />ЋЊ substantial improvements to the existing building located <br />ЋЋ at 2929 Long Lake Road. This lease also includes a commitment to improve the parcels <br />ЋЌ immediately west of 2929 Long Lake Road along County Road C2 with a surface parking <br />ЋЍ facility. FedExÓs proposed use and employment needs at 2929 Long Lake Road necessitates the <br />ЋЎ need to create additional employee parking at 2373 and 2395 County Road C2. The proposed <br />ЋЏ site plan depicts 243 parking spaces. The parking lot is intended for employee-only parking, <br />ЋА unlike the proposal reviewed in January that included van parking. <br />ЋБ Table 1005-1 for the Mixed-Use Districts includes parking as a principal use and requires an <br />ЋВ approved Conditional Use (CU) that complies with City Code requirements, including <br />ЌЉ§1009.02.C. The applicant has entered into a purchase agreement with Robert Beugen, owner of <br />ЌЊ the two adjacent residentially-used properties at 2373 and 2395 County Road C2, and seeks <br />ЌЋ approval of a CU to facilitate construction of the necessary surface parking lot on these two <br />ЌЌ parcels. <br />PF22-015_RPCA_AUNI_Holding_CU_020123 <br />Page 1 of 5 <br /> <br />
