iv. Restoration of wetlands; 317 <br />v. Limiting vegetation removal and/or riparian vegetation restoration; 318 <br />vi. Provisions for the location, design, and use of structures, sewage treatment systems, water 319 <br />supply systems, watercraft launching and docking areas, and parking areas; and 320 <br />vii. Other conditions the zoning authority deems necessary. 321 <br />b. In evaluating plans to construct sewage treatment systems, roads, driveways, structures, or 322 <br />other improvements on steep slopes, conditions to prevent erosion and to preserve existing 323 <br />vegetation screening of structures, vehicles, and other facilities as viewed from the surface of 324 <br />public waters assuming summer, leaf-on vegetation shall be attached to permits. 325 <br />7. Nonconformities 326 <br />a. All legally established nonconformities as of the date of this ordinance may continue, but will 327 <br />be managed according to Minnesota Statues, 462.357 Subd. 1e and other regulations of this 328 <br />community for alterations and additions; repair after damage; discontinuance of use; and 329 <br />intensification of use. 330 <br />b. All additions or expansions to the outside dimensions of an existing nonconforming structure 331 <br />must meet the setback, height, and other requirements of Sections 1012.03.E to 1012.03.H of 332 <br />this ordinance. Any deviation from these requirements must be authorized by a variance. 333 <br />8. Notifications to the Department of Natural Resources 334 <br />a. All amendments to this shoreland ordinance must be submitted to the Department of Natural 335 <br />Resources for review and approval for compliance with the statewide shoreland management 336 <br />rules. The City of Roseville will submit the proposed ordinance amendments to the 337 <br />commissioner or the commissioner’s designated representative at least 30 days before any 338 <br />scheduled public hearings. 339 <br />b. All notices of public hearings to consider variances, ordinance amendments, or conditional 340 <br />uses under shoreland management controls must be sent to the commissioner or the 341 <br />commissioner’s designated representative at least ten (10) days before the hearings. Notices 342 <br />of hearings to consider proposed subdivisions/plats must include copies of the 343 <br />subdivision/plat. 344 <br />c. All approved ordinance amendments and subdivisions/plats, and final decisions approving 345 <br />variances or conditional uses under local shoreland management controls must be sent to the 346 <br />commissioner or the commissioner’s designated representative and postmarked within ten 347 <br />days of final action. When a variance is approved after the Department of Natural Resources 348 <br />has formally recommended denial in the hearing record, the notification of the approved 349 <br />variance shall also include the summary of the public record/testimony and the findings of 350 <br />facts and conclusions which supported the issuance of the variance. 351 <br />d. Any request to change the shoreland management classification of public waters within the 352 <br />City of Roseville must be sent to the commissioner or the commissioner’s designated 353 <br />representative for approval, and must include a resolution and supporting data as required by 354 <br />Minnesota Rules, part 6120.3000, subp.4. 355 <br />RCA Attachment A <br />Page 12 of 32
