FOOD AND BEVERAGE SERVICES <br />AGREEMENT BETWEEN <br />City of Roseville and Burro Loco Restaurant <br />THIS AGREEMENT, made and entered into this tenthday of April, 2023, by and between the <br />City of Rosevillea municipal corporationand Burro Loco <br />LLC,a Minnesota limited liability company, hereinafter referred to as Burro Loco <br />SECTION 1 -PURPOSE <br />1.The City owns and operates the Cedarholm Community Building and Golf Course <br />(. <br />2.The City desires to contract withafoodand beverage providerto provide such services, <br />including catering and alcohol services. <br />3.The City desires to designate Burro Locoas theexclusive food and beverage providerat <br />Cedarholmduring the term of this contract. The City does reserve the rightto use or allow <br />anotherfood and beverageservice provider in the event of default occurring under this <br />agreement or upon termination of this agreement. <br />SECTION 2-DUTIES AND RESPONSIBILITIES OF BURRO LOCO <br />1.Burro Loco agrees to provide food and beverage services, catering, and alcohol services <br />for Cedarholm,including provision of adequate staff, supplies, and appropriate <br />licensing. <br />2.Burro Loco agrees to provide the Services according to the following schedule: <br />a.May 1-August 31: 11am-9pm. <br />b.March 1-April 30 & September 1-October 31: 11am-7pm. <br />c.November 1-February28-as needed for events and the golf season. <br />Any derivation from this schedule must be approved, in writing, by the City at least two weeks <br />prior to the schedule change. <br />3.Burro Locoagrees to obtain, maintain,and to periodically provide the City with a copy of <br />the current licensure by the State of Minnesota and the City for service of food and alcohol <br />during the term of this Agreement. Burro Locoagrees to meet all local/state/federal health <br />regulations, codes, rules,and laws concerning Restaurant and Alcohol service. <br />4.Burro Locoaccepts full and exclusive liability for all employees, servers, agents,and <br />others it directs and controls to perform the Services and shall pay all applicable Social Security <br />required employee benefits. <br />DOCSOPEN\\RS160\\1\\861069.v4-3/10/23 <br /> <br />
