(Ord. 1142, 6- <br />93 13-1994) <br />94 <br />95 309.02 LICENSE FOR MASSAGE THERAPY ESTABLISHMENT <br />96 <br />97 A. License Required: No person shall engage in the business of operating a <br />98 massage therapy establishment within the City without first having obtained the <br />99 required license. <br />100 B.Application Fee: The initial application for a license shall be made by <br />101 completing an application form provided by and containing such information <br />102 as required by the City Manager and by paying a nonrefundable application fee, <br />103 as established by the City Fee Schedule in Section 314.05. (Ord. 1329, 11-14- <br />104 05) <br />105 C.Separate License Required Fee: A separate license shall be obtained for each <br />106 place of business,the fee for which shall be as established by the City Fee <br />107 Schedule in Section 314.05. (Ord. 1329, 11-14-05) <br />108 <br />109 309.03 LICENSE REQUIRED, EXCEPTIONS. <br />110 <br />111 A. License Required: No person shall engage in the business of operating a <br />112 massage therapy establishment or perform massage therapy in the City without <br />113 first having obtained the required license. <br />114 B.Massage Therapy Establishment Exceptions: A massage therapy establishment <br />115 license is not required for entities duly licensed or operating as a hospital, <br />116 nursing home, hospice, sanitarium or group home established for the <br />117 hospitalization or care of human beings provided the massage is administered <br />118 only to the residents or patients of the facility as part of their care and not <br />119 provided as a part of a separate service. <br />120 C.Massage Therapy License Exceptions: A massage therapy license is not <br />121 required for the following persons: <br />122 1. Persons duly licensed as a doctor by this state to practice medicine, <br />123 surgery, osteopathy, chiropractic, physical therapy or podiatry, provided <br />124 the massage is administered in the regular course of the medical <br />125 business as it prepares the patient for a medical procedure or <br />126 complements a medical procedure previously performed on the patient <br />127 and not provided as part of a separate and distinct massage business. <br />128 2. Persons working solely under the direction and control of a duly <br />129 licensed doctor by this state to practice medicine, surgery, osteopathy, <br />130 chiropractic, physical therapy, podiatry, dentistry or a medical <br />131 professional licensed under M.S. Chapters 147 and 148, as they may be <br />132 amended from time to time, provided the massage is administered on <br />133 the premises of the medical business; <br />134 3. Students of an accredited institution who are performing massage <br />135 services in the course of a clinical component of an accredited program <br />136 of study, provided that the students are performing the massage services <br />RS160\\1\\850086.v5 <br /> <br />
