Attachment C 273 A.Display of License: Any person registered as a massage therapist hereunder 274 shall display such license, with a color photo or a true copy thereof, in a 275 prominent place at such person's place of employment on the premises at which 276 the therapist is employed. 277 B.Identification: Upon demand of any police officer at the place of employment, 278 any person licensed hereunder shall produce correct identification, identifying 279 himself/herself by his/her true legal name and correct address. 280 C.Inspection: During business hours, all massage therapy establishments shall be 281 open to inspection by City Building and License Inspectors, Health Officers 282 and police officers. The issuing authority, or designee, and/or the City Police 283 Department shall have the right to enter and inspect the licensed premise during 284 the hours in which the licensed premise is open for business. 285 D.Therapist, Change of Location: Any person licensed hereunder shall practice 286 massage only at such location or locations as are designated in the license. Any 287 person registered hereunder shall inform the City Manager, in writing, of any 288 change in location prior to its occurrence. 289 D.Transfer of establishment license. A Massage Establishment License may be 290 transferred by a license holder to another person at the licensed location, 291 provided that the transferee files a license application and meets the 292 requirements to hold a license. A Massage Establishment License may be 293 transferred by a license holder to another location to be operated by that license 294 holder, provided that the license holder files a license application and the new 295 location meets the location requirements. Notwithstanding the ability to transfer 296 an establishment license mentioned above, no transfer shall be permitted if any 297 of the following apply: 298 a.The license to be transferred has received notice of the City’s intention to 299 revoke such license, unless, after reasonable notice and an opportunity for 300 the licensee to be heard, the license is not revoked. 301 b.The transfer is to be made on or after May 1, 2028. 302 c.There was a transfer of the Massage Establishment License at that location 303 after May 1, 2023. 304 E.Hours: No customers or patrons shall be allowed to enter or remain on the 305 licensed premises after 9:00 P.M. or before 8:00 A.M. daily. 306 F.The establishment may only provide services during business hours which must 307 be posted on the door. The business must be staffed at all times during such 308 posted hours. 309 G.Alcohol or Drugs Prohibited: No beer, liquor, narcotic drug or controlled 310 substance, as such terms are defined by State statutes or the City Code shall be 311 permitted on licensed premises. 312 H.Violation of Building, Safety or Health Regulations: Violation of any law or 313 regulation relating to building, safety or health shall be grounds for revocation 314 or any license. 315 I.Locks on Doors: There shall be no locks on doors of massage rooms. 316 J.Appropriate Covering Required: 317 a.Patron: Whenever a massage is given, it shall be required by the 318 massage therapist that the person who is receiving the massage shall RS160\\1\\850086.v5
