Attachment D <br />183 academic record from the school issuing the training, degree or <br />184 diploma in the following areas: <br />185 1) The theory and practice of massage, including, but not <br />186 limited to, Swedish, Esalen, Shiatsu and/or foot reflexology <br />187 techniques; and <br />188 2) Anatomy, including, but not limited to, skeletal and <br />189 muscular structure and organ placement; and <br />190 3)Anatomy, physiology, hygiene, ethics, massage theory and <br />191 research, and massage practice. <br />192 B.Fee: The annual license fee for a massage therapist is as established by the City <br />193 Fee Schedule in Section 314.05. Ord. 1329, 11-14-05) <br />194 C.Review of Application: Notwithstanding Section 301.02 of City Code, License <br />195 applications shall be reviewed and decided upon by the City Manager or <br />196 designee and shall include a review by the Police Department or other qualified <br />197 service providers in conducting and completing criminal background checks. <br />198(Ord 1615, 07-25-2022) <br />199 D. Denial of Application: The license application may be denied for any of the <br />200 following reasons: <br />201 1. Fraudulent Statements: The application contains false, fraudulent, or <br />202 deceptive statements. <br />203 2. Prior Conviction: The applicant has been convicted of or entered a plea <br />204 of guilty within the previous three years to a violation of this Chapter or <br />205 of any other law regulating the practice of massage, or of any law <br />206 prohibiting criminal sexual conduct, prostitution, or indecent conduct. <br />207 3. Noncompliance: The applicant has not complied with a provision of this <br />208 Chapter. <br />209 4. Underage: The applicant is less than eighteen (18) years of age. Prior Denial, Revocation, or Suspension: The applicant has had a <br />212 massage therapist license denied, revoked, or suspended in another <br />213 jurisdiction. <br />214 6. Violation of Chapter: A violation of any provision of this Chapter. <br />215 7. Unlawful Conduct. Any unlawful conduct including, but not limited to, <br />216 criminal sexual conduct, prostitution, or indecent conduct, regardless of <br />217 whether such conduct resulted in a criminal conviction. <br />218 8. Violations of Law Relating to Practice of Massage Therapy. Any <br />219 violation of laws or ordinances relating to the practice of massage <br />220 therapy, regardless of whether such conduct resulted in a criminal <br />221 conviction. <br />222 9. In the event of a license denial based solely or in part on a criminal <br />223 conviction, the City will follow the process outlined in Minnesota <br />224 Statutes Chapter 364. <br />225 10.
