REQUEST FOR COUNCIL ACTION <br />Date: April 24, 2023 <br />Item No.:7.a <br />Department ApprovalCity Manager Approval <br />Item Description:Consider an extension to the May 5, 2023 compliance date for removal of two <br />“micro-units” at 2555 Victoria Street N <br />1 B ACKGROUND <br />2 On March 6, 2023 the City Council, acting as the Board of Adjustment and Appeals, considered an <br />3 appeal of a staff decision that two micro-units erected at 2555 Victoria Street N were not permissible <br />4 dwelling units and must be removed from the property. Asa component of the appeal, it was also <br />5 determined that recreational camping areas are not allowed in the City, so considering the micro-units <br />6 as recreational vehicles was not appropriate either. The adopted Resolution and meeting minutes are <br />7 included herein as Attachments D and C respectively. <br />8 <br />9 Since the March 6, 2023 City Council meeting, City staff and Prince of Peace (PoP), and respective <br />10 legal counsels, have been meeting to discuss apath forwardto compliance. Of specific concern is the <br />11 displacement of the two families currently occupying the micro-units and existing legislation at the <br />12 State that would permit the two micro-units to remain. The State legislation, as currently drafted, <br />13 would subject the micro-units to compliance with health and safety conditionsand municipalities <br />14 making determinations on whether a sacred community meeting the State legislation would be <br />15 approved and regulated as a permitted use, conditional use, or plannedunit development. A current <br />16 draft the Senateversion of thebill is included within PoP’s written request for the extension <br />17(Attachment B). Council should beaware that if this bill passesthe City will need to amend it’s <br />18 Zoning Code to determine whether such use will be permitted, conditional, or by planned unit <br />19 development and such amendment should be enacted on or before January 1, 2024, the effective date <br />20 of the bill. <br />21 <br />22 PoP submitted a written request to extend the compliance period from May 5, 2023 to July 30, 2023. <br />23 The reasons for the extension include the following: <br />24 Allows time for a decision to be made on passage of the State legislation (known as Sacred <br />25 Communities and Micro-Unit Dwellings) that would permit the use of micro-unitsfor <br />26 permanent housing for people that are chroncially homeless, extremely low-income,or <br />27 designated volunteers, and <br />28 Alllows PoP time to undergo the Interim Use Permit process, which would serve as a way to <br />29 permit the micro-units through the end of the year, assuming the State legislation passes.PoP <br />30 hasbegun this process by submittingthe required Open House application, paid the required <br />31 application fee,and setting a date for the Open House meeting. Their written materials outline <br />32 their expected timeline for the Open House(May 21, 2023)and submittal of the Interim Use <br />33 application(by June 2, 2023). Assuming this timeline is met, a final decision on the Interim <br />34 Use would likely be determined by the end of July. <br />Page 1of 3 <br /> <br />
