REQUEST FOR COUNCIL ACTION <br />Date:April 24, 2023 <br />Item No.: 10.c <br />Department ApprovalCity Manager Approval <br />Item Description:Resolution Approving Metropolitan Council Easement Agreements <br />1 B ACKGROUND <br />2 In 1971, the City of Roseville entered into an agreement with the Metropolitan Council <br />3(AttachmentI) to convey parts of the City’s sanitary sewer collection system over to the <br />4 Metropolitan Councilto become region interceptor pipes. Under terms of the original agreement, <br />5 the City was to convey all property (pipes and manholes) and dedicate easements over these pipes to <br />6 the Metropolitan Council. <br />7 In 2017, as the MetropolitanCouncil was doing a project in Roseville, their staff found three <br />8 segments of the Metropolitan Council Interceptors that were not turned over properly. Metropolitan <br />9 Council staff worked with our attorney to finalize the terms of the sale. <br />10 In order to finalize the agreement, the City will need to approve Bill of Sale (Attachment B) which <br />11 conveys the real property (pipes and manholes) to the Metropolitan Council. A Quit Claim Deed <br />12(Attachment C) needs to be approved to transfer any easement interest that the City has to the <br />13 Metropolitan Council. Finally, three new easement agreements need to be approved so that <br />14 Metropolitan Council has access to the infrastructure. <br />15 All three locations are within city parks. Two are in Central Park North and one is in Central Park. <br />16 City staff, including parks and recreation staff, worked with our attorney and Metropolitan Council <br />17 staff to modify the easement language to allow the existing encroachments within the parks. No <br />18 direct impacts to parks are anticipated with the approval of these documents. Metropolitan Council <br />19 has indicatedthat, similar to the Villa Park Project in 2017, they will work with the City when future <br />20 projects occur in these areas to minimize impactswithin the parks. <br />21 The City Attorney has reviewed all documents. <br />22 P OLICY O BJECTIVE <br />23 It is City policy to keep City-owned infrastructure in good operating condition and to keep systems <br />24 operating in a safe condition. <br />25 B UDGET I MPLICATIONS <br />26 There are no costs to the City of Roseville to related to this property transfer. <br />27 R ACIAL E QUITY I MPACT S UMMARY <br />28 There should be no equity impacts associated with this agreement. <br />Page 1of 2 <br /> <br />
