EXHIBIT A TO QUIT CLAIM DEED <br />The permanent utility easements legally described below (the “Permanent Utility Easements”) over, <br />under and across the properties legally described below for, without limitation, the location, installation, <br />construction, repair, replacement, maintenance, use, and operation of a sewer interceptor/lift <br />station/meter and other related improvements. The Permanent Utility Easements include the rights of <br />ingress and egress over and across the below described properties by Grantee and its agents, <br />employees, permittees and contractors, for the use of the Permanent Utility Easement areas as may be <br />necessary in the exercise of the rights and privileges herein granted. <br />The Permanent Utility Easements further include the right to cut, trim, or remove from the Permanent <br />Utility Easement areas any trees, shrubs, undergrowth or other vegetation as in the Grantee’s judgment <br />unreasonably interferes with the use of the Permanent Utility Easement areas by Grantee, its <br />permittees, successors and assigns, provided that Grantee shall take all reasonable precautions to <br />prevent any damage to the property. <br />Subsequent to the date of the Quit Claim Deed, Grantor, its successors and assigns, will not erect, <br />construct, or create any building, improvement, obstruction, perpendicular utility crossing, or structure <br />of any kind, either above or below the surface of the Permanent Utility Easement area or plant any <br />trees, or stockpile construction debris or construction equipment, or change the grade thereof of the <br />Permanent Utility Easement areas without the express written consent of the Grantee. <br />Legal Descriptions of the Permanent Utility Easement Areas: <br />Exhibit A – 1 – RV – 430 <br />An approximate depth of 7-12 feet over and across a strip of land described as follows: The <br />northerly 20 feet of Lot 5, Block 1, St. Anthony Plaza. <br />05.29.23.22.0121 – Abstract Document 1533921 <br />An approximate depth of 6 to 18 feet over and across a strip of land described as follows: The <br />Northerly 20 feet of the Southerly 1135 feet of the following described parcel: That part of the <br />NW ¼ of Section 5, Township 29, Range 23, described as follows: Beginning at a point on the S. <br />line of said NW ¼ distant 2078 feet E. of the SW corner thereof; thence N. at right angles to said <br />S.line, 1285 feet; thence E. 245.8 feet more or less to a point distant 857.14 feet SE of the <br />center line of Trunk Highway No. 8, measured on a line running SE at right angles to said center <br />line from a point distant 1128.34 feet SW of the intersection of said center line with the N. line <br />of said NW ¼; thence on a prolongation of afore described line running SE, 502.34 feet more or <br />less to the E. line of said NW 1/4; thence S. on said E. line to SE corner of said ¼; thence W. on S. <br />line thereof, 566.52 feet more or less to point of beginning excepting the S. 484 feet of the E. <br />270 feet thereof. <br />05.029.23.24.0006 and 05.29.23.24.0007 Abstract Document Number 1555601 - (SS-5-5) <br />1 <br /> <br />
