ВЉ SANITARY: Free from the vegetative cells of pathogenic microorganisms. (Ord. 1142, 6- <br />ВЊ 13-1994) <br />ВЋ <br />ВЌ 309.03 LICENSE REQUIRED, EXCEPTIONS. <br />ВЍ <br />ВЎ A. License Required: No person shall engage in the business of operating a <br />ВЏ massage therapy establishment or perform massage therapy in the City without <br />ВА first having obtained the required license. <br />ВБ B. Massage Therapy Establishment Exceptions: A massage therapy establishment <br />ВВ license is not required for entities duly licensed or operating as a hospital, <br />ЊЉЉ nursing home, hospice, sanitarium or group home established for the <br />ЊЉЊ hospitalization or care of human beings provided the massage is administered <br />ЊЉЋ only to the residents or patients of the facility as part of their care and not <br />ЊЉЌ provided as a part of a separate service. <br />ЊЉЍ C. Massage Therapy License Exceptions: A massage therapy license is not <br />ЊЉЎ required for the following persons: <br />ЊЉЏ 1. Persons duly licensed as a doctor by this state to practice medicine, <br />ЊЉА surgery, osteopathy, chiropractic, physical therapy or podiatry, provided <br />ЊЉБ the massage is administered in the regular course of the medical <br />ЊЉВ business as it prepares the patient for a medical procedure or <br />ЊЊЉ complements a medical procedure previously performed on the patient <br />ЊЊЊ and not provided as part of a separate and distinct massage business. <br />ЊЊЋ 2. Persons working as, or solely under the direction and control of, a duly <br />ЊЊЌ professional licensed by the Board of Medical Practice or the Minnesota <br />ЊЊЍ Department of Health licensed doctor by this state to practice medicine, <br />ЊЊЎ surgery, osteopathy, chiropractic, physical therapy, podiatry, dentistry <br />ЊЊЏ or a medical professional licensed under M.S. Chapters 147 and 148, as <br />ЊЊА they may be amended from time to time, provided the massage is <br />ЊЊБ directly related to the medical or health treatment and is administered <br />ЊЊВ on the premises of the medical or health business; <br />ЊЋЉ 3.Students of an accredited institution who are performing massage <br />ЊЋЊ services in the course of a clinical component of an accredited program <br />ЊЋЋ of study, provided that the students are performing the massage services <br />ЊЋЌ at the location of the accredited institution and provided the students are <br />ЊЋЍ identified to the public as students of massage therapy. <br />ЊЋЎ <br />ЊЋЏ 309.04 GRANTING, DENYING, SUPENDING OR REVOKING OF MASSAGE <br />ЊЋА THERAPY ESTABLISHMENT LICENSES <br />ЊЋБ <br />ЊЋВ A. Application Fee: The initial application for a license shall be made by <br />ЊЌЉ completing an application form provided by and containing such information <br />ЊЌЊ as required by the City Manager and by paying a nonrefundable application fee, <br />ЊЌЋ as established by the City Fee Schedule in Section 314.05.
