Denial of Application: The license application may be denied for any of the <br /> following reasons: <br /> 1. Fraudulent Statements: The application contains false, fraudulent, or <br /> deceptive statements. <br /> 2. Prior Conviction: The applicant has been convicted of or entered a plea <br /> of guilty within the previous three years to a violation of this Chapter or <br /> of any other law regulating the practice of massage, or of any law <br /> prohibiting criminal sexual conduct,prostitution,or indecent conduct. <br /> 3. Noncompliance:The applicant has not complied with a provision of this <br /> Chapter. <br /> 4. Underage: The applicant is less than eighteen (18) years of age. (Ord. <br /> 1142, 6- 13-94) <br /> 5. Prior Denial, Revocation, or Suspension: The applicant has had a <br /> massage therapist license denied, revoked, or suspended in another <br /> jurisdiction. <br /> 6. Violation of Chapter: A violation of any provision of this Chapter. <br /> 7. Unlawful Conduct. Any unlawful conduct including,but not limited to, <br /> criminal sexual conduct,prostitution,or indecent conduct,regardless of <br /> whether such conduct resulted in a criminal conviction. <br /> 8. Violations of Law Relating to Practice of Massage Therapy. Any <br /> violation of laws or ordinances relating to the practice of massage <br /> therapy, regardless of whether such conduct resulted in a criminal <br /> conviction. <br /> 9. In the event of a license denial based solely or in part on a criminal <br /> conviction, the City will follow the process outlined in Minnesota <br /> Statutes Chapter 364. <br /> 10. Lack of Skill: Exhibition of a demonstrable lack of skill in the practice <br /> of massage therapy. (Ord. 1142, 6-13-94) <br /> 309.06: RESTRICTIONS AND REGULATIONS FOR MASSAGE THERAPY <br /> ESTABLISHMENTS AND MASSAGE THERAPIST LICENSES: <br /> A. Display of License: Any person registered as a massage therapist hereunder <br /> shall display such license, with a color photo or a true copy thereof, on the <br /> premises in public view at which the therapist is employed. <br /> B. Identification: Upon demand of a representative of the issuing authority, or <br /> designee, and/or the City Police Department at the place of employment, any <br /> person licensed hereunder shall produce valid photo identification,identifying <br /> himself/herself by his/her true legal name and proof of address. <br /> C. Inspection: A representative of the issuing authority, or designee, and/or the <br /> City Police Department shall have the right to enter and inspect the licensed <br /> premise during the hours in which the licensed premise is open for business. <br /> D. Hours: No customers or patrons shall be allowed to enter or remain on the <br /> licensed premises before 8:00 A.M. or after 9:00 P.M. daily. <br />
