GENERAL OBLIGATION BOND PROCEEDS <br />Municipal Publicly Owned Infrastructure Inflow/Infiltration Grant Program <br />INTERGOVERNMENTAL GRANT AGREEMENT BETWEEN METRO- <br />POLITAN COUNCIL AND ROSEVILLE <br />This Intergovernmental Grant Agreement (“Grant Agreement”) is made this day <br />of , 2023, and entered into by and between the Metropolitan Council a public corpo- <br />ration and political subdivision of the State of Minnesota (“Council”) and, Roseville a Minnesota <br />Municipal corporation (“Grantee”). <br />RECITALS <br />A. The Minnesota Legislature has appropriated to the Council in the 2020 Session Laws <br />Chapter 3, Section 17, subdivision 2, $5,000,000, for a grant program to be administered by the <br />Council. This appropriation is for the purpose of providing grants to municipalities for capital im- <br />provements to public municipal wastewater collection systems to reduce the amount of inflow <br />and infiltration to the Council’s metropolitan sanitary sewer disposal system (“I/I Municipal <br />Grant Program”). <br />B. The monies allocated to fund the appropriation to the Council are proceeds of state gen- <br />eral obligation bonds authorized to be issued under Article XI, §5(a) of the Minnesota <br />Constitution. <br />C. The Council has gone through a public process and formally adopted Guidelines for the <br />I/I Municipal Grant Program. Grantee has read and understands the Council Guidelines (“Council <br />Guidelines”). <br />D. The Council has identified Grantee as a contributor of excessive inflow and infiltration <br />to the Council’s metropolitan sanitary sewer disposal system and thus an eligible applicant for <br />grant funds under the I/I Municipal Grant Program. <br />E. Pursuant to its authority under Minnesota Statutes §444.075 [or other authority, if dif- <br />ferent], Grantee operates a municipal wastewater collection system identified as Roseville Waste- <br />water Collection System (“Wastewater System”) and has submitted an application to and been <br />approved by the Council for grant funds in the amount of $158,509, for performance of functions <br />and activities for its inflow and infiltration mitigation capital improvement project to the Waste- <br />water System in accordance with Council guidelines. <br />F. Council has reviewed and found eligible Grantee’s application for grant funds and has <br />awarded such grant funds (“G.O. Grant”) to Grantee to construct a capital improvement project <br />to Grantee’s pipeline as described in and in accordance with the terms and conditions of this <br />Grant Agreement. <br />G. The Grantee’s receipt and use of the I/I Municipal Grant Program to acquire an owner- <br />ship interest in and/or improve real property (the “Real Property”) and structures situated thereon <br />(the “Facility”) will cause the Grantee’s ownership interest in all of such real property and struc- <br />tures to become “state bond financed property”, as such term is used in Minn. Stat. §16A.695 <br />(the “G.O. Compliance Legislation”) and in that certain “Fourth Order Amending Order of the <br />Commissioner of Finance Relating to Use and Sale of State Bond Financed Property” executed <br />by the Commissioner of Minnesota Management and Budget and dated July 30, 2012 (the <br />Generic GO Bond Proceeds <br />Grant Agreement for Program End Grants 1 Ver – 10/26/20
