1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 PUBLIC IMPROVEMENT CONTRACT <br />12 FARRINGTON ESTATES <br />13 <br />14 <br />15 I.Parties. This Agreement, dated ____________, 2016, is entered into between the City of Roseville, <br />16 a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, Minnesota <br />17 55113 (“the City”), and Farrington Estates LLC, a Minnesota limited liability company (the <br />18“Owner”) whose address is 18140 Zane Ave NW #314, Elk River, MN, and New Design Properties, <br />19 LLC, a Minnesota limited liability company whose address is 9183 190th Ave NW, Elk River, MN <br />20 55330(collectively the “Developer”). <br />21 II.Request for Plat approval.The Developer has asked the City to approve a plat of land to be known <br />22 as “Farrington Estates”(also referred to in this Agreement as the “Plat”). The land is legally <br />23 described as follows: <br />24 See Legal Description attached as Exhibit Ahereto (the “Property”). <br />25 <br />26 III.Terms and Conditions of Plat Approval. For good and valuable consideration, the receipt and <br />27 sufficiency of which are hereby acknowledged, the parties agree as follows: <br />28 A.Plat Approval:Subject to the terms and conditions of this Public Improvement Contract, the <br />29 recitals above, and all other applicable City Code provisions, the City hereby approves the recording <br />30 of the Plat. <br />31 B.Land Use: Low Density Residential. <br />32 C.Public Improvements.The Developer shall, subject to the terms and conditions contained herein, <br />33 perform the following work and construct the following improvements (“Public Improvements”) in <br />34 compliance with City approved Public Improvement Construction Plans described in Section III D <br />35 below and all rules, regulations, standards and ordinances of the City: <br />36 1.Site Grading and Turf Restoration. The Developers shall grade the Property in <br />37 accordance with the City approved Grading, Drainage and Erosion Control Plan. Site <br />38 grading improvements shall include common excavation, subgrade correction, <br />39 embankment and pond excavation. The Developer shall turf restoration on the Property <br />40 which shall include seeding, mulching and erosion control. <br />41 a)The Developer shall submit to the City a site grading and drainage plan for the entire <br />42 Plat acceptable to the City showing the grades and drainage for each lot prior to <br />43 installation of the improvements. <br />Page 1 of <br /> <br />
