32 Storm sewer construction: The Developer shall construct all storm sewer improvements <br />33 determined to be necessary by the City to serve the Property, including the construction <br />34 of outlet control structures and flared end sections. <br />35 o Storm sewer facilities, including ponds and infiltration basins, shall be <br />36 constructed in accordance with City details, specifications, and the City approved <br />37 Public Improvement Construction Plans. <br />38 o Storm water basins shall be protected from silt during construction. If these areas <br />39 do not function as designed, the Developer shall reconstruct them as directed by <br />40 the City Engineer. <br />41 Restoration of existing streets: Curb cuts and street cuts shall be reconstructed to match <br />42 existing street typical section. <br />43 o All unused curb openings along County Road B W and Farrington Street curb line <br />44 shall be removed and replaced with non- surmountable curb to match existing. <br />45 Curbs proposed to be replaced shall have a minimum of 3 feet of bituminous saw <br />46 cut out to allow for proper compaction. <br />47 o Utility trenches shall be restored by the Developer per City standard plate. <br />48 Erosion control. Prior to the commencement of any grading and before any utility <br />49 construction is commenced or building permits are issued, the erosion control plan must <br />50 be implemented, inspected and approved by the City. The Developer shall meet all <br />51 ance including but not limited to the <br />52 following. <br />53 o No construction activity shall be allowed and no building permits shall be issued <br />54 unless the Property is in full compliance with the erosion control requirements. <br />55 o Measures shall be installed in compliance with MPCA NPDES permit <br />56 requirements. <br />57 o The City shall inspect the site periodically and determine whether it is necessary <br />58 to take additional measures to address erosion. <br />59 o To remove dirt and debris from streets that has resulted from construction work <br />60 by the Developer, its agents or assigns, the Developer shall sweep streets on a <br />61 weekly basis or more frequently as directed by the City Engineer until the site is <br />62 stabilized. The Developer must sweep roadways with a water-discharge broom <br />63 apparatus. Kick-off brooms shall not be utilized for street sweeping. <br />64 o If the development on the Property does not comply with the erosion control plan <br />65 or supplementary instructions received from the City, the City may, following <br />66 giving the Developer 48-hour prior verbal notice (or immediately in the case of an <br />67 emergency), take such action as it deems appropriate to control erosion, the cost <br />68 of which action shall be paid by the Developer to the City upon demand. <br />69 All work would be done through the contractor. All costs for the improvements <br />70 would be paid by the developer. The estimated cost of construction of the public infrastructure is <br />71 $80,000. The developer will provide a financial security in the amount of 125% of the estimated <br />72 cost of construction ($100,000) in the event the developer fails to perform. <br />73 The City would provide oversite on the construction. The Developer will pay the City $3,200 for <br />74 these inspection services. <br />Page 2 of 3 <br /> <br />
