REQUEST FOR COUNCIL ACTION Date:July 10, 2023 Item No.:10.f Department ApprovalCity Manager Approval Item Description: Approve the renewalof a short term rental license for 1885 ShadyBeach Avenue 1 B ACKGROUND 2 Chapter 909 of City Code requires the licensing of non-owner occupied short term rentals of dwelling 3 units, subject to certain exemptions. On February 13, 2023 the City Council adopted amendments to 4 Chapter 909, which stopped the issuance of any new short term rental licenses but allowed renewals 5 of previously approved licenses. The original short term renal license for 1885 Shady Beach Avenue 6 was issued on June 22, 2021. On May1, 2023, an application for renewal of the shortterm rental 7 license was submittedby the property owner. The property is a four bedroom, single family home. 8 The property owner has certified and attested to the requirement of lodging tax payment, as well as, 9 the maximum occupancy of four or less unrelated adults or one family.The subject property’s current 10 short term rental licenseis valid through June 22, 2023. There have been no nuisance or property 11 maintenance violations in the last five yearsthat impact the ability of the license to be issued. Short 12 term rentals licenses include the requirement of minimum stays based on on-season (10 days) and off- 13 season (7 days) times of the year. 14 Upon renewal,the license will be valid for 365 days from the expiration date of the current license.A 15 current copy of the license must be posted in the rental unit, along with current copies of City Code 16 Sections 405, 407 and 602. A draft of the license is provided as AttachmentB. 17 The applicant has supplied all required license information and paid the license fee of $515. In 18 accordance with Section 909.03, the process for licensure is outlined in Chapter 301, which requires 19 presentation to the City Council. Based upon the requirements outlined in ordinance, the property 20 owner is entitled to the license. 21 P OLICY O BJECTIVE 22 Licensing required by Section 909, effective as of February 8, 2021. 23 B UDGET I MPLICATIONS 24 The correct fees were paid to the City at the time of application submittal. 25 R ACIAL E QUITY I MPACT S UMMARY 26 Staff has not identified any racial equity impacts related to this action.
