Regular City Council Meeting <br /> Monday,August 7,2023 <br /> Page 5 <br /> smoke, and he has his own views on that,but he does understand that some people <br /> smoke, and it is a legal thing. The City does not want to make it so impossible for <br /> people either. <br /> Mayor Roe thought it is probably able to be said that smoking marijuana products <br /> is both creating smoke that can be an irritant and annoyance to people, which <br /> smoking tobacco products also does. But,it is also a controlled substance in a sense <br /> that it does some of the same or similar things to its users as what alcohol does. <br /> The City does not allow use of alcohol in the City parks, specifically, so it could be <br /> said that it would be consistent, at least in the point of view of it being a substance <br /> that can create impacts to or impair people's abilities, similar to alcohol. If the <br /> purpose of not permitting alcohol in the parks is to prevent issues related to that, it <br /> could be sensible to say the same relating to use of these products, at least higher <br /> potency products. He did not know if the City wanted to draw the line on some of <br /> the lower potency products that may be harder to know whether people are using it <br /> in the first place. He could see where the City may be able to put some distinction <br /> there and put that into the City Code. There is also the question of whether the <br /> Council just talks about the parks specifically or talks about more broadly other <br /> spaces. But then he would turn the question back around and ask what the City is <br /> doing with respect to consumption of alcohol in these other places. <br /> Councilmember Schroeder indicated she is having trouble with the lower potency <br /> Hemp derived consumer products. She noted there are salves, and some things so <br /> what would be put in here. She wondered if it could all be lumped together. <br /> Councilmember Groff thought it would be terrible to enforce something like that. <br /> Mayor Roe asked if there was a sense that the Council is okay with the broad <br /> prohibition and specific to these products or does the Council want to look at <br /> something more specific to parks and/or potentially other public spaces more in the <br /> public realm, like City owned. Then talk about the different types of products and <br /> how to treat those, or does the Council need to table this for further discussion with <br /> the whole Council and potentially more information from staff and the attorney if <br /> there are certain questions about, for instance, sorts of these edibles and what their <br /> "potency"is relative to other products the Council might think of like alcohol. <br /> Councilmember Groff indicated he was leaning that way, but thought this was a <br /> broad enough subject, this is the information, and it will not hurt to delay it a little <br /> bit to have a discussion with the whole Council or at least one more member would <br /> be better. <br /> Councilmember Schroeder thought more information would be better. <br /> Mayor Roe noted another option would be the Council could act on the first part of <br /> the Ordinance and strike out the second part, if the Council wanted to, at least <br />
