Replacement trees shall be from balled and burlapped, certified nursery stock as defined and <br />controlled by MN Star. 18.44 through 18.61, the Plant Pest Act, as may be amended from time to <br />time. Replacement trees may also be from bare root stock, provided the trees are planted no later <br />than May 15th in any year, and the planting is inspected by the City Forester or other degreed <br />forester or certified arborist as assigned by the Community Development Department. <br />3887 <br />4. <br />Replacement trees shall be covered by a minimum 2-year guarantee in accordance with Section <br />3888 <br />1011.04(M). <br />3889 <br />5. <br />When heritage trees are removed, replacement trees options shall be as determined by the City <br />3890 <br />Forester or other degreed forester or certified arborist as assigned by the Community <br />3891 <br />Development Department. <br />3892 <br />6. <br />Replacement trees for significant and common trees may be selected by the applicant, but all final <br />3893 <br />planting plans shall be subject to review and approval by the City Forester or other degreed <br />3894 <br />forester or certified arborist as assigned by the Community Development Department, who will <br />3895 <br />determine whether the proposed trees are suitable to the site, are well placed, and accomplish <br />3896 <br />local diversity goals. <br />3897 <br />7. <br />Replacement trees may be utilized to meet landscaping and screening requirements if placement, <br />3898 <br />species, and location are consistent with those requirements. <br />3899 <br />8. <br />Replacement Tree Locations. Required replacement trees shall be planted on the site being <br />3900 <br />developed unless doing so is deemed to be impractical (i.e. due to lack of space), inappropriate <br />3901 <br />(available planting areas are not ideal for new plantings or would do little to enhance the site), or <br />3902 <br />counterproductive to a property's intent (i.e. would entail too much screening for a retail <br />3903 <br />business) as determined by the City Forester or other degreed forester or certified arborist as <br />3904 <br />assigned by the Community Development Department. When such a determination is made, the <br />3905 <br />applicant shall comply with replacement requirements in one of three ways in the following <br />3906 <br />manner: <br />3907 <br />a. As directed by the City, required replacement trees may be located on private property within <br />3908 <br />1000 feet of the subject development site with the consent of the property owner(s), on public <br />3909 <br />improvement project sites that are not greater than 1000 feet from the development site, or on <br />3910 <br />other public and private lands that are not greater than 1000 feet from the development site if <br />3911 <br />such lands are deemed to be available, with priority given to locations near the affected area; <br />3912 <br />or <br />Page 29 of 89 <br />
