3949 a. Any tree, not previously identified for removal, that is determined by the City Forester or <br />3950 other degreed forester or certified arborist as assigned by the Community Development <br />3951 Department to be destroyed or damaged as a result of development activity shall be replaced <br />3952 at the following rates: <br />Category <br />Replacement Rate <br />Heritage Trees <br />2.5 <br />Significant Trees <br />1.5 <br />Common Trees <br />1.0 <br />3953 b. Unauthorized tree removal which results in mandatory replacement shall require the applicant <br />3954 to prepare or update a final planting plan as required by Section 1011.04(G)(3)(c). <br />3955 Replacement plantings shall only occur once authorized by the City Forester or other degreed <br />3956 forester or certified arborist as assigned by the Community Development Department. <br />3957 L. Certification of Compliance with Approved Landscape Plan. Upon completion of construction <br />3958 activity and/or required landscaping, the Developer shall notify the City and request an inspection of <br />3959 the work. Following the inspection, the City shall notify the Developer that additional work is still <br />3960 required, or issue a letter finding that all plantings have been satisfactorily completed. The required <br />3961 warranty period for plantings shall begin on the date of the issued satisfactory completion letter. <br />3962 M. Warranty Requirement <br />3963 1. New Development Sites: The Developer shall provide a financial guarantee, in a form satisfactory <br />3964 to the City, prior to the approval or issuance of any permit for land alteration. <br />3965 a. The amount of the guarantee shall be 125% of the estimated cost to furnish and plant <br />3966 replacement trees. The estimated cost shall be provided by the Developer subject to approval <br />3967 by the City. The estimated cost shall be at least as much as the reasonable amount charged by <br />3968 nurseries for the furnishing and planting of replacement trees. The City reserves the right in <br />3969 its sole discretion to determine the estimated cost in the event the Developer's estimated cost <br />3970 is not approved. <br />3971 b. The security shall be maintained for at least 2 years after the date that the last replacement <br />3972 tree has been planted. Upon a showing by the Developer and such inspection as may be made <br />3973 by the City, that portion of the security may be released by the City equal to 125% of the <br />3974 estimated cost of the replacement trees which are alive and healthy at the end of such year. <br />3975 Any portion of the security not entitled to be released at the end of the year shall be <br />3976 maintained and shall secure the Developer's obligation to remove and replant replacement <br />3977 trees which are not alive or are unhealthy at the end of such year and to replant missing trees. <br />3978 Upon completion of the replanting of such trees the entire security may be released. <br />3979 2. Development or Redevelopment of Existing Lots: The developer shall provide a cash escrow in <br />3980 the amount of $500.00 to guarantee compliance with the requirements of this Ordinance. Said <br />3981 security shall be released upon compliance by the developer to the satisfaction of the City. <br />3982 Notwithstanding the foregoing, no portion of the security shall be released while there are <br />Page 31 of 89 <br />
