(h) Size of bench. No bench shall be more than 42 inches high nor more than 30 inches wide or seven feet long <br />overall. <br />Sec. 14-261. Indemnity bond or liability insurance. <br />(a) Before a license shall be issued pursuant to this division, the applicant shall post or maintain with the issuing <br />authority a bond or policy of public liability insurance approved by the city attorney and conditioned <br />substantially as follows: <br />(1) The licensee will indemnify and save harmless the city, its officers, agents, and employees from any <br />and all loss, costs, damages, expenses, or liability which may result from or arise out of the granting of <br />such license or the installation or maintenance of such bench for which a license is issued, regardless of <br />the point to which the bench may be moved within the city, with or without the consent of the <br />licensee; and <br />(2) The licensee will pay any and all loss or damage that may be sustained by any person as a result of or <br />which may be caused by or arise out of such installation or maintenance. <br />(b) Such bond or policy of insurance shall be maintained in its original amount by the licensee at the licensee's <br />expense and at all times during the period for which the license is in effect. <br />(c) If the applicant is issued a license for two or more benches, one such bond or policy of insurance may be <br />furnished to cover all of the applicant's benches, and each bond or policy shall be of the type for which <br />coverage shall automatically be restored immediately after the occurrence of any accident or loss from <br />which liability may thereafter accrue. <br />(d) The limit of liability upon any bond or policy of insurance so posted shall in no case be less than $300,000.00 <br />for a loss, bodily injuries or death occurring to any one person or arising out of any one accident, and no less <br />than $100,000.00 for property damage. <br />(Council Amend. of 9-28-2015) <br />Sec. 14-262. Renewal. <br />(a) At least 30 days prior to the expiration of any license issued pursuant to this division, the licensee may make <br />written application for renewal thereof, accompanied by the applicable license fee. Such application for <br />renewal shall contain the information required in the original application. <br />(b) If the owner of the land or the lessee upon the premises abutting that portion of the street where the bench <br />is located granted to the license holder the continuing right to maintain such bench, the application must so <br />state, and renewed consent shall not be required. <br />Sec. 14-263. Sanctions for violations. <br />(a) Suspension orrevocation of license. The city council may suspend or revoke a license issued pursuant to this <br />division for a violation of the following: <br />(1) Fraud, misrepresentation, or false statement contained in a license application or a renewal <br />application. <br />(2) Fraud, misrepresentation, or false statement made in the course of carrying on the licensed occupation <br />or business. <br />(3) Any violation of this article or state law. <br />(Supp. No. 8) <br />Created: 2022-e6-15 17:e1:55 [EST] <br />Page 3 of 4 <br />Page 81 of 89 <br />
