Regular City Council Meeting <br /> Monday, October 9, 2023 <br /> Page 9 <br /> Etten moved, Schroeder seconded, to reconsider the action on the Applebee's <br /> compliance check violation. (Business Item 7c) <br /> Roll Call <br /> Ayes: Etten, Schroeder, Groff, Strahan, and Roe. <br /> Nays: None. <br /> Strahan moved, Groff seconded, approval to issue and administer the presumptive <br /> penalty pursuant to City Code Section 302.15, for on-sale license holders for the <br /> first violation within thirty-six(36)months. The mandatory minimum penalty shall <br /> be a one-thousand-dollar ($1,000.00) fine (as opposed to the previously-approved <br /> higher fine) and a one (1) day suspension for Applebee's. <br /> Roll Call <br /> Ayes: Etten, Schroeder, Groff, Strahan, and Roe. <br /> Nays: None. <br /> f. Consider Presumptive Penalty Approval — 2023 Alcohol Compliance Check <br /> (LaCasita) <br /> Deputy Police Chief Joe Adams briefly highlighted this item as detailed in the <br /> Request for Council Action and related attachments dated October 9, 2023. <br /> A representative was at the meeting but did not choose to address the Council. <br /> Groff moved, Strahan seconded, approval to issue and administer the presumptive <br /> penalty pursuant to City Code Section 302.15, for on-sale license holders for the <br /> first violation within thirty-six(36)months.
