The City shall have the right, during the term of the Contract, to have a representative on <br />Contractor's premises to monitor the operation of the Contract. Such representative shall only be <br />allowed on Contractor's premises during normal business hours. <br />4.6 End Market Certification <br />The Contractor shall provide in its Proposal and by January 31 of each year through the term of <br />the Contract written certification to the City that all recyclable commodities identified are indeed <br />recycled and not disposed. Such written certification shall identify all end markets' <br />manufacturers or processors used for each of the recyclable commodities. The Contractor shall <br />attach written certification from each end market and a list of products manufactured using the <br />recyclable materials collected from the City. The Contractor shall specify the percentage of each <br />material collected that goes to each end market. Contractor must request in writing if it wishes to <br />have the certification be considered proprietary information. <br />5 Payment and Liquidated Damages <br />5.1 Term of Contract <br />The term of the new recycling Contract will be a period of 42 months from January 1, 2022, <br />through June 30, 2025. <br />5.2 Compensation for Services <br />The City agrees to pay the Contractor for recycling collection services provided to the City as <br />described in Exhibit G of this agreement. <br />Contractor shall submit itemized bills for recycling collection services provided to the City on a <br />monthly basis. Bills submitted shall be paid in the same manner as other claims made to the City. <br />The Contractor shall submit with the monthly bill the monthly documentation and reports. <br />Payment to the Contractor will not be released unless the required paperwork is included in the <br />monthly bill or submitted separately according to the deadlines specified in this Agreement. <br />5.3 Multi -Unit Dwellings Billing <br />The City agrees to pay the Contractor for recycling collection services provided to the City as <br />described in Exhibit G of this agreement. The City will designate new or additional buildings to <br />receive service with 30 days -notice to Contractor. <br />5.4 Incident Escalation <br />The City and the Contractor shall communicate on a regular and as needed basis related to <br />customer complaints, accidents, and other incidents. The use of liquidated damages is intended to <br />be used only after regular communications to resolve complaints or performance issues.
