R. Failure to provide sufficient cart or container inventory information for customer use— <br />$500 per incident. <br />S. Failure to provide adequate notice (within two hours of Contractor's decision to delay <br />collections) and coordination to prevent mixed public messages about collection delays <br />due to severe weather incidents — $2,000 per incident. <br />T. Failure to accurately and promptly answer a resident's question to the Contractor's <br />customer service call center— $100 per incident. <br />U. Employees smoking in enclosed structures while performing duties, extinguishing <br />smoking material anywhere other than in container or not following general no -smoking <br />rules — $50 incident. <br />V. Failure to provide accurate call center responses to Roseville residents' questions per the <br />City's FAQs guidance document — $500 per incident. <br />W. Failure to follow the federal or state equal opportunity laws and rules - $1,000 per <br />incident. <br />X. Failure to clean up hydraulic leaks or other fluid spills - $250 per incident <br />Y. Failure to clean up trash left behind after collection - $100 per incident <br />The Contractor shall be liable for liquidated damages in the amount(s) set forth above upon <br />reasonable determination of the City that performance has not occurred consistent with the <br />provisions of the Contract. The City shall notify Contractor in writing or electronically of each <br />act or omission in this Contract reported to or discovered by the City. It shall be the duty of <br />Contractor to take steps or action reasonably necessary to remedy the cause of the complaint. <br />The City may deduct the full amount of any liquidated damages from any payment due to the <br />Contractor. <br />5.6 Services Not Provided For <br />No claim for services furnished by the Contractor not specifically provided for herein shall be <br />honored by the City. <br />6 Insurance and Other Legal Requirements <br />6.1 Insurance <br />Insurance secured by the Contractor shall be issued by insurance companies acceptable to the <br />City and admitted in Minnesota. The insurance specified may be in a policy or policies of <br />insurance, primary or excess.
