, <br />6 <br />i <br />�. C. PennEy Company desires to operate one of its <br />typical Al�to Centers in conjunction with its department <br />stcre in Har-M�,r Center. This unit must be a free standing <br />building located near the department store. The only feas- <br />ible location for such a building in Har-Mar Center is at <br />the locatiion shown on th� attached map, just North of the <br />department store and just South of County Road B. It is <br />propos�d to have this building set back from County Road <br />B�he same distance as the gas station building to the <br />West, approximately 63 feet. Because of the size of the <br />Auto Center building and the available space, it is not <br />practical to have a greater set-back from County Rcad B <br />than 63 feet. <br />Section �.030 of the Roseville Zoning Code provides <br />for a front � <br />yard set-back of 100 fe�t but indicates that <br />where design. conditions or other considerations indicate <br />a variance would not conflict wsth the general purpose <br />and intent of the code, a variance wi11. be granted. Here <br />the gas station building has already Established a building <br />line and set-back from County Road B. <br />The proposed Auto Center will be a one story building <br />and will not impair an adequate supply of light and air to <br />adjacent property. Use of this property as an Auto Center <br />should not increase congesticn nor increase the danger of <br />fire or endanger public safety since the property will be <br />used for parking purposes if t�le Auto Center is not erected, <br />a,nd f.hese lises ar� very comparable. Slnce the nearest <br />homes ar� over �00 fe�t away to the East and the proposed <br />building will be further from the apartment buildings to <br />the Sou�ch and Eas� than the pr�esent Penney Store, this <br />variance could not unreasonably diminish or impair <br />established pr�perty values or impair health, safety, <br />comfort, morals or in any other respect be contrary to <br />the intent oi' the zoning ordinance. <br />
