k <br />REQUEST FOR COUNCIL ACTION DATE: 6/08/87 <br />ITEM NO.: <br />r <br />Department Approval: Manager Reviewed: Agenda Section: <br />Hearings <br />Item Description: Kayo Oil Company's request for rezoning, Special Use <br />Permit, and variance at 1583 County Road C. <br />The Planning Commission, at its June 31, 1987 meetin on a six to one vote, of the Kayo Oil Company requestrecomfor rezoningpatoval, <br />1583 County Road C. In addition, the Planning Commission unanimously <br />recommended approval of the Special Use Permit, and variance at 1583 <br />County Road C. The variance and special use attached the following <br />conditions: <br />1. That thirty feet of right-of-way be dedicated on County Road C. <br />2. That there be a provision of a new sewer easement, and that said <br />sewer construction be completed according to City specifications. <br />The applicant shall furnish the City reproducible as builts upon <br />completion. <br />3. That a concrete sidewalk be constructed on the contiguous public <br />right-of-way, subject to staff review, and/or placement of funds <br />in escrow for sidewalk requirements. <br />4. That staff approve final landscape plan, with larger trees required. <br />5. That the building be constructed of brick on all. four sides, that <br />matches the Byerly's color. <br />6. That a drive access be provided, if necessary, for access to <br />contiguous properties to the north. <br />7. That the development be constructed per plans submitted April 30, <br />1987. <br />8. That the applicant return to the next Planning Commission meeting <br />with more information on exterior of building, and signage. <br />9. That the parapet height be increased to cover the mechanical <br />systems on the roof. <br />COUNCIL ACTION REQUESTED: <br />Motion approving/denying Kayo Oil Company's request for rezoning at <br />1583 County Road C. <br />Motion adopting an ordinance rezoning property at 1583 County Road C, <br />from I-1 to B-4. <br />Motion approving/denying Kayo Oil Company's request for Special Use <br />Permit, and variance at 1583 County Road C, with the aforementioned <br />conditions if so desired. <br />
