As you all know, the Lincoln Companies, <br />general partners <br />of the <br />Roseville., Shoppes Limited Partnership, <br />have developed and <br />nearly <br />completed the Rosedale Square Shopping <br />Center where Byerly's <br />is the <br />southerly most anchor. Since their <br />fall opening, early indications <br />suggest that it is a highly successful <br />development beneficial <br />to the <br />developers and the pul.Aic as well. <br />2. You will recall the existence of a major ponding area at the southeast <br />corner of the site which is a part of the public right-of-way 'as <br />indicated on the attached map of that area of the City and the, site <br />plan submitted by the applicant. You will also recall that the City <br />approved a variance to the parking setback on the west side of the <br />ponding area in order to maximize the parking potential, recognizing <br />that the 15 foot setback normally required (for parking to a public <br />right-of-way) is far exceeded by the existence of the ponding area. <br />3. Likewise, the location now for a <br />proposed <br />ground sign is similarly <br />effected. The applicants propose to <br />place the sign 30 feet back <br />from <br />the County Road C public right-of-way <br />(to the <br />south), but within 5 <br />feet <br />of the right-of-way on the east side of the <br />ponding area. It would <br />appear the intent of the ordinance <br />to keep <br />the signs back from <br />the <br />public right-of-way is amply served <br />in the location <br />proposed since <br />the <br />sign will actually be approximately <br />72 feet <br />westerly of where <br />the <br />right-of-way would normally be if the <br />ponding <br />area did not exist at <br />this <br />location. <br />4. Attached is a copy of the statement prepared by the applicant, a site <br />plan, and a drawing illustrating the nature and size of the sign. The <br />shopping center is allowed up to three pylon signs of 250 square fleet <br />each, thus the development proposal is considered to be less than the <br />signage i.hat could be accommodated on the site. <br />5. In summary, <br />the application is for <br />a variance <br />to the sign location. If <br />approval is <br />considered, a condition <br />could be <br />that the sign be 30 feet <br />from County <br />Road C, 5 feet from <br />the ponding <br />area right-of-way on the <br />east side of <br />the site, and that the <br />sign be <br />constructed in accordance <br />with the drawings as illustrated and <br />submitted <br />on the attached drawing. <br />
