This application was tabled at the last regular meeting of the PVanning <br />Commission to give time for the applicants and thei - contiguous <br />neighbor to the east to work out a property line dispute. To date <br />(July 20th) Staff has not heard frorn either of the parties involved <br />regarding any potential solution or proposed action. We spoke with 'Ar. <br />Sherman Winthrop, Attorney for Mr. Joe Most who is the owner of the <br />apartment structure to the west, who informs us that there has been no <br />contact between the parties during the interim period. Mr. Winthrop <br />notes that Ashland Oil is a large corporation and it may be a time <br />consuming process before any decisions are made. <br />2. Unless a property line agreement happens In the interim, the Planning <br />Commission and Council should adjourn the hearings for another month <br />pending some solution to the property line dispute among the affected <br />parties. Obviously, in this case, they location of they property line will <br />have significant influence on the merit and the final adjustment on the <br />variance proposed. It would appear that any action on the part of they <br />City at this point may contribute to the dispute: and make a solution <br />more difficult. <br />
