Ashland Oil has indicated to Mr. <br />Jopke that the various agreements are being conveyed to Mr. Mast and <br />his attorney this week, with the apparent intent to accomplish this <br />agreement prior to the Planning Commission meeting. Therefore, it <br />would appear that the extended negotiations and revisions to the site <br />plan may be agreed upon prior to the Planning Commission hearing (or <br />perhaps not). <br />In addition, the current site plan proposes the closing of one of the <br />three existing driveways to the site off of Lexington Avenue. Staff has <br />encouraged this step and has suggested that it will improve the <br />functioning of the site and improv, safety conditions on Lexington <br />Avenue. <br />Back in 19849 Staff recommended and the Planning Commission <br />concurred that the required 16-1/2 feett of dedication on Lexington <br />Avenue should be accomplished as a part of the variance request at <br />that time. It was recommended that the actual right-of-way to be <br />dedicated would be rm)uced to 16 feet since that was the distance to <br />the existing curb. The Council approved the variance in 1984, but did <br />not require the right-of-way dedication. At this tirne, since there is <br />now an adjustment in props-`.y lines (a land division), the right -of -waxy <br />dedication in again triggered. Therefore, we suggest that the Planning <br />Commission sand Council consider any o tion on this site to include a <br />condition that tine It, feet of right-of-way be dedicated. <br />Landscaping <br />A revised landactapea (elan has boon prepared, which appears adoquoto it <br />the existing Dodge Is loft intact.
