Application for Vacation of Right -Of -Ways and Final Plat Item 19.E The vacation of various right-of-ways and existing easements presently located on the site for Centre Pointe Business Park is necessary to allow the development to be built according to plans previously submitted and approved by the City of R:jseville. This development is located between County Road D and the Highway Department pond just north of County Road C and between 35W right- of-way and Cleveland Avenue. This area was previously divided into various single family residences, a trucking terminal and a gas station which are to be removed for the development of Centre Pointe Business Park. Among the right-of-ways to be vacated is a street named Raymond Avenue and an extension of County Road C-2 to connect Raymond Avenue to Cleveland Avenue. Also, when the various residential dwellings within this area were built, various easements had been granted to provide for these uses. Since the use for this area is to be changed and Raymond Avenue and County Road C-2 are to be replaced by Centre Pointe Drive, new utility easements are to be created along with the new road configurations and requirements of this development. Due to various delays in the ability to plat this site, we are presently requesting vacation of certain easements and right-of- ways with others to be vacated and modified during platting. Attached to this statement are a list of easements and right-of- ways to be vacated prior to recording the plat for Centre Pointe Business Park and another list of easements which are to be vacated with the filing of the plat for this site. With the filing of the plat new easements and right-of-ways will be created to accommodate the new use for this area. The developer has met with the City personnel to review this proposed course of action and to discuss specifically each easement. The City staff has approved the proposed vacations and abandonments by the letter dated May 26, 1987 enclosed.
